WHEREAS by the twenty
fourth fcftion of the full
article of the con dilution, it is
among other thing* declared
that the foregoing TeAion of this
article having declared the com
mon lights of rhe free citizens or
this ftate, in and to all the ter
ritory without the prelcnt boun
dary line, and within the limits
of this Rate, thereby defined, by
which the contemplated pur
chafers of certain companies,
of aconfidcrable portion there
of are become conftitutionally
vo'id, “ and juflice and good
faith, require, that the ftate
fhould not detain a confideration
for a contra# which has failed,
thclegiflatureat their next feffion
fliall make provifion by law for
returning to any perfon or per
fons who has or have bona fide
depofited monies for fuch pur
chafcs in the treafury of this
ftate; Provided , that the fame
fhali not have been drawn there
from, in terms of the a# palled
the thirteenth^day of February,
one thou fond feven hundred and
ninety-fix, commonly called the
refeinding a#, or the appropri
ation laws of the years one thou
fand feven hundred and ninety
fix, and one thou fand feven hun
dred and ninety-feven ; nor fhali
the monies paid for fuch pur
chafes ever be deemed a part of
the funds of this ftate, or be
liable to appropriation as fuch,
but until luch monies be drawn
from the tieafury, they fhali be
confidered altogether at the

treafury, or paid to the faid pre
tended grantees, their acknow
ledged agents or any perfon or
perfons in whofe name or names
any fum or Turns of money has
or have been lodged in the trea
lury, for or on account of any
or either the pretended compa
nies as aforefaid, and that the
receipt produced is the original
receipt of the treafurer, grantee?,
agent or perfon or perfons in
whofe name or names any fum
or fums of money Has or have
been lodged in the treafury as
aforefaid, given at the time the
money was paid, and that he or
they has or have therewith deli
vered in all pretended docu
ments relative to any pretended
title in his or their poffeflion or
power, under the pretended au
thority aforefaid, which (hall be
filed in the treafury office, and
the oath be there fubfciibed and
preserved ; fhali iftue to the per
fon or perfons depofiting the
fame as aforefaid, a certificate
expreffing the date, name or
names, together with the fum
mentioned in the document de
pofited as aforefaid ; Provided
always , and it is hereby enacted,
That the treafurer (hall not re
ceive any fuch pretended docu
ment chargeable to any of the
pretended companies in the trea
fury books, exceeding the Turn
or fums depofited by each of the
refpe&ive pretended companies,
and which is in the treafury at
the time fuch receipt cr pretend
ed document is prefented to
him ' nor fhali he give any cer
tificate or certificates for any fum
or fums of money exceeding the
amount which may be in the
treafury as aforefaid, at the credit
of the aforefaid rclpeftivc pre
tended firms.
And he it further enaHed by the
authority afore/aid, That his Ex
cellency the Gover-nor be, and
he is hereby atnhorifed and re
quired on receiving the certifi
cate or certificates of the trea
furer as aforefaid, to iftue an
order to the treafurer in the
words following :
“ You are hereby required to
return out of the monies depo
fited by A. B. pretended com
pany, or by C. D. who held a
receipt for monies paid to Qron
account of faid pretended com
pany now filed in the treafury,
agreeably to your certificate of
and debit the faid
pretended company with the
fame."
