Certain rules are prescribed for their conduct while they remain and they may be required to leave the country. When tins policy is considered best a certain period is fixed within which aliens may depart with their property after war has been declared, and incase they leave the country within this specified lime their property is safe from confiscation during their passage to their own or to some neutral country. Even after the period thus fixed lias expired it is usually poasi bio for aliens to secure permission to de¬ part with all their effect as harsh dealing with these people by one belligerent would bo sure to call forth similar harsh¬ ness from the other. Beiigerents have right us soon as war is declared to seize any cargoes in their ports, but the practice among civilized nations now is to give notice of the time in which shipping must be removed. The domicile of the owner fixes the na¬ tionality of a ship unless the ship sails under the flag and registry of another nation. The Hag itself m not sufficient proof of the ship’s nationality. The crew list, shipping articles, register aud so on, are taken as final proof of her na¬ tionality. Belligerents are not entitled to search the war vessels of neutrals and private neutral vessels may only be i searched for “probable cause.” Persons not bo taken from a neutral ship while at sea on the ground that they are citi¬ zens of the nation claiming them for the purpose of impressment. The mere capture of a ship does not give title to the vessel or her cargo. The | capturing crew must take the captive iuto port and secure her condemnation by tho proper court. If the captor can¬ not tako the prize into a port of its own country ho may take it to a neutral port, sell it and deposit the money thus re¬ ceived as soon as he reaches si prize court in his own country. In case of emergency the captor may destroy the prize or allow her owners to ransome j her. The goods of an enemy on a ueu- tral ship may be seized, but (lie non- j j contraband goods of a neutral on an enemy's ship may not be taken. Con¬ traband goods are taken wherever lotind.
