petition of J. J. Freeman, C. H. Henderson,
1. Hamilton, E. D. Beavers, W. M. Kiser, G.
Moore, A. J. Powell, D. Demery, R. D. Reed,
‘A. C. Carmichael, J. Head, M. Willis, J. Wil
son, W. L. Busby, L. C. Jackson, G. D. Ly
man, J. Millians, P. C. Sheriff, R. Bowdon, A.
H. Jackson, D. Elder, W. M. Hill, M. T. Ram
sey and M. Logan, of said county, shows the
foliowing facts:
1. Petitioners, together with their associates,
desire to be incorporated under the name of
MARIETTA MERCANTILE & INVESTMENT
COMPANY
for a period of twenty (20) years, with the
right to renew said charter at the expiration
of said time. |
2. The object of said corporation is pecu
niary gain, and to carry on and maintain
a general mercantile business in the city of
Marietta, Ga., and to buy and sell goods,
wares and merchandise, cotton, corn and oth
er products, groceries, meats and any other
article or articles that may be dealt in by
said corporation, including an undertaking
business, dealing in coffins and funeral sup
plies of all kinds, and conducting and direct
ing funerals, charging therefor, and doing
any kind of business usually done by under
taking establishments, and to make contracts,
borrow money and pledge as security therefor
any of the properties, either real or personal
‘owned by said corporation, loan money, sue
and be sued, and to have the right to buy,
own, hold and sell real estate, and to do any
and all acts that may be necessary in the
operation of said corporation’s business that
are not inconsistent with the aws of the
State and United States.
8. The principal place of business will be
in the City of Marietta, Cobb County, Ga., and
they desire the privilege of establishing
branches and doing business in any other
place that they may deem to their interest.
4. The ' capital stock of said corporation
shall be Five Thousand ($5,000) Dollars, di
vided in shares of $25.00 each, and they de
sire to begin business when ten per cent.
(10 per cent) of said capital stock is paid in.
5. Petitioners desire that said corporation
shall have the right to elect officers and di
rectors by a vote of its stockholders, and to
have and make all proper and necessary by
laws and regulations as may be proper for
the carrying on of said business, and to have
and use a common seal.
WHEREFORE, Petitioners file this their pe
tition in the office of the Clerk of the Superior
Court and pray that after the same has been
advertised as required by law that the Court
by proper order, grant thi spetition.

DRAINAGE NOTICE
To All The Landowners In The Noses Creek
Drainage District No. 3.°
You will take notice that it is the purpose
of the Board of Drainage Commissioners of
the Noses Creek Drainage District No. 3 to
issue bonds for the payment of the total costs
of the improvements in the amount of Fifty
Thousand Dollars. These bonds to draw six
per cent interest, payable annually, and are
payable in ten annual installments, said bonds
to begin bearing interest September 1, 1919,
and the first interest installment to be paid
January 1, 1920 and the flrst principle install
ment to be paid January 1, 1922. Any land
owner having lands assessed in the district
not wanting to pay interest on the bonds may,
on or before the Ist day of September 1919
pay to the County Treasurer the full amount
for which his land is liable, which for
Class A land is $35.90 per acre
Class B land is $28.72 per acre
Class C land is $21.54 per acre
Class D land is $14.36 per acre
Class E land is $ 7.18 per acre
said amounts having been ascertained from
the classification sheet and the certificate of
the Board showing the total cost of the im
provements. The land on which the assess
ments are paid shall be released from liability
to be assessed for the said improvements, but
such lands shall continue liable for any future
assessments for maintenance under the law.

By virtue of an order of the Court of Or
dinary of Cobb County will be sold, at Pub
lic outery, on the First Tuesday in September
1919, at the court-house door in said county,
between the legal hours of sale the following
described tract of land, to-wit: A one-half
undivided interest in and to thirty acres of lot
of land No. 16, except a small part in the
Northern corner lying North of the cross
road leading from A. N. Mayes to A. H. Tal
ley’'s making said road the line. Forty aecres
of lot No. 59 and 10 acres, more or less, on
tl_\e West side of lot No. 90. All in the 19th
dlstrict and 2nd section Cobb county, Georgia.
Said lands and said interest in said lands
belonging to the estate of Mrs. Cornelia Ward,
late of said county, deceased, and sold for the
purpose of paying debts and for distribution
among the heirs of said deceased.

(6191,) feet to a point; then in a southerly
direction six hundred thirty-five and ten
twelfths (635-10/12) feet to a point; then in

three hundred thirty-seven and one-half
(337-14) feet South of starting point; and
thence to starting point: and being part of
original lot of land No. Four hundred and

dred Seventy (570) feet to the rear line of
the tract hereby conveyed; then in a Souther-

and fifty (250) feet to a point on said rear
line; thence in a northeasterly direction 66 feet
to & point; thence in an easterly direction Four
Hundred and Ninety-five (495) feet to a point
on the West side of the Marietta and Atlanta
road; thence in a Northerly direction along
said road One Hundred and Seventy (170) feet
to the beginine point, which is approximatelv
Three Hundred Seventy (370) feet measured
along the Atlanta Marietta roadwav. North of
the Northeast corner of E. H. Thompson's
land. The tract of land herein conveved lies
iust North of Smvrna on the road to Marietta
Ga., and on the West side of said Atlanta and
Marietta road. and is a rart of the nvanartv
described in that certain Bond for Title from
Sarah L. Mcllntvre to W. H. Hughes, which
was by W. H. Hughes transferred to W. M.
Fambrough. which original Bond for Title and
Transfer to W. M. Fambrough is recorded in
Naaq Rook “53" page 273 of the records of
Cobb County, Georgia.
It is the intention that rear line of the
proverty hereby conveyed shall go back West
wardly to the rear line of the propertv as des
cribed in said Bond for Title from Sarah L.
Meclntyre to W. H. Hughes, which bond was
transferred to W. M. Fambrough as stated
above.
Levied on as the properiy of W. H.Hughes
to satisfy an execution issued from the Cobb
Superior Court in Favor of Mrs. Sarah L. Me-
Intyre and against W. H. Hughes, a deed hav
ing been filed and recored for the purpose of

THE HAND OF NATURE
’ Man may build for permanency of
‘stone and concrete but the hand of
‘time and the laws of nature soon
‘put at naught all puny human effort.
In the city cemetery of Marietta
years ago, was constructed a vault
in which were sealed the caskets of
metal containing the remains of a
family. Memory of these people had
faded from the minds of the oldest
citizens. The massive concrete vault
was built to hide the bones until the
resurrection trump should ecall.
But nature, with her seasons of
heat and cold, had decreed otherwise.
Out of the earth, at the head of the
vault had sprung a tender plant,
which the rains and the sun of years
nurtured and strengthened into a vig
orous cottonwood tree.
With added years it grew and sent
forth its roots into the soil, and under
the vault of concrete it took deeper
root, until one day the strain was
so great that the massive wall was
rent open, and the end of the vault
fell away, letting in the sunlight and
the curious gaze of humanity upon
the crumbling forms.
And then man came again with
cement and stone and closed the rent
with a new wall, which the hand of
nature will destroy again in her own
way and in her own good time, be
it a day or a thousand years.
MRS. TELFORD, OF GAINES
VILLE, DIES ON MONDAY
The host of friends of Mrs. W. A.
DuPre will greatly regret to learn of
the death of her sister, Mrs. Telford,
of Gainesville, which occurred on
Monday.
Both Mrs. Telford and her son, Mr.
Baylor Hickman, had made many
friends here on their visits to Mrs.
DuPre, and all are saddened by her
death.
