Oratorical Contest.
There will be an oratorical contest by
representatives of the Marietta High
School on Friday night, April Bth, at
the Armory to decide who shall repre
sent the school at the Seventh Congres
sional District High School Assoeiation
meeting.
Governor Joseph M. Brown has of
fered two prizes, one for the best de
claimer among the boys and ope for
the best reciter among the girls.
A small admission fee will be charg
ed to defray expenses and for the bene
fit of the sehool library.

Negro Boy Sentenced for Life.
Johnson Flanagan, who was last
week convicted for murder in the homi
cide of Willie Jackson, was sentenced
to the pententiary for and during the
term of his natural life. An unusual
leature about this case is the fact that
one grand jury had failed to find a
true bill in the case at a former term,
but the boy was subsequently indicted |
for the capital offense, and, as stated ‘
last week, convicted. A motion for|
new trial has been filed, which will l)e'
neard at the first motion court.

The depositors of the bank of Kenne
saw were paid the amounts of their
claims in full by Receiver B. A. Fite
on Tuesday. The total amount of
deposits at the time of the failure of
the bank was $14,000.

tee in Harmonious Meet
ing Arranges for the
Election.
The county primery will be held on
Thursday, May 12th. That date was
selected by the Democratic Executive
Committee which met at the court
house Saturday. There was a full at
tendance.
Mr. E. L. Neufvill was elected chair
man; Colonel E. P. Green, vice-chair
man, and Comer C. Baker, secretary.
Resolutions embodying the rules
governing the primary will be found
below :
Rules for the Primary.
STATE OF GEORGIA, Cobb County.
Be it resolved by the Democratic Ex
ecutive Committee of said County, now
in session, that a white primary be and
the same is hereby crdered to be held
in said County for the purpose of nom
inating cavodidates for Clerk of the
Superior Court, Sheriff, Treasurer,
Tax Collector, Tax Receiver, County
Surveyor, County School Commissioner
and Coroner for the October election,
1910. Said primary is ordered to be
held on May flch. 1910, under the rules
and regulations fixed by this cemmit
tee, and as provided by law in the Acis
of 1908 governing primary elections.
Section 1. Said primary shall be
held at the Court House of each Mili
tia Distriet in said County, by the Ex
ecuiive Committee of their respective
district, throughout the Coanty, who
will be authorized to employ aclerk or
clerks when needed, provided that all
managers and their clerks shall take
and subscribe the oath now provided
by law to be taken by managers of
primary elections, provided that if the
Executive Committee of said district
should fail or refuse to hold said pri
mary election in their respective dis
trict on the day fixed by this commit
tee, and bpen said election at the hour
provided by these resolutions, then any
two qualified voters of said distriet
present at the place for holding said
eleetion, may proceed to open and
hold said primary election under the
same rules and regulations provided‘
for holding said elections. i
Section 2, It is further ordered that
a committee of three be selected from
this body to formulate and prepare
what shall be designated the cfficial
ballot for said primary; said ballot
shall contain all the names of the can
didates for the various offices. Said
Committee shall have all necessary
tickets printed, and get up all blanks
necessary for helding said election, in
cluaing registration lists, and furnizh
the Executive Committee of each Mi
litia District an amount sufficient for
the needs of each distriet. Said Com
mittee so appointed shall collect all
assessments fixed by this body on each
candidate for the purpose of defraying
the expense of said primary.” Said
committee shall furnish the managers’
of the various districts with a ligt of all |
the qualified voters of their respective \
district, and they may employ some
one to copy the names from the veri
fied list of qualified voters as compiled
by the registrars of said county for
each militia district thereof, aud in
the event that the registrars have not
completed the revision of said voters
list in time for said committee to get
out the lists for said primary, then
said committee shall have copies made
from the registration list of the Tax
‘Collector’s office for the different diz
triets of said County. After seid lists
have been copied, said Committee
shall verify and certify the same to
the managers of said election in their
espective district.
““Qaction 3. No person shall be al
lowed to vote in said primary whose
name does not appear on the registra
tion list so furnished the managers,
and each persop voting in said election
must cast his ballot in the district of
his residence.
Section 4. Any person using money
| or whiskey or any other shing of value
to influence voters, shall forfeit the
right of having himseif declared the
nominee of the office for which he is
running, even though heshould receive
the required vote to entitle him to the
nomination, and on information
furnished this body that any person
‘Whose name is placed on the official
ballot who uses any of the above
named meang, will be declared not en
titled to have any votes he may re
qtve counted.
‘Section 5. The managers of said
election in the several districts of the
couaty, shall send into the County site
by one of their number, the tally
sheets, voters lists, oaths, ballots and
any other papers connected with the
holding of said election, duly certified
and under seal, by 12 o’clock noon on
the day following said primary elec
tion, for the purpose of consolidating
the votes cast and declaring the results,

filed in the office of the Clerk of the
Superior Court of said County, and
held open for publie inspection, and
all the other papers in said election
ghall be gecurely sealed and deposited
in the same office, and shall remain
therein until the first meeting of the
Grand Juary of the County, after which
the same shall be publicly destroyed
withcut inspection. by the committee
appointed by this body, provided there
is no legal proceedings to prevent the i
same, \
Section 6. No ballot other than the
official ballot shall be counted in said
primary election.
Section 7. Inasmuch as some of the
managers of primaries for Marietta
District have heretofore held some
elections under the Australian ballot
'syétem and the same having proved
satisfactory, it is ordered that, the
managers of the several Militia Dis
yit.ricts of said County may provide for
'the holding of said primary election
‘under the Australian ballot system, if
they deem it advisable; and, that im
mediately after the elose of the polls
of said election they shall proceed to
count the ballots.
Section 8. In addition to the offices
to be filled as named in heading of theae
resolutions, there will be County Com
missioners to_be nominated in Road
Distriet No.’l, which includes Marietta
District only, and in Road District No.
x which includes Austell, Coxes, How
ells, Lemons, Vinings and Smyrna Dis
tricts. Candidates for these offices will
be voted for only in their respective
districts.
Section 9. The following assessment
is hereby to be collected from the re
spective candidates, the same not to be
paid later than fifteen days before said
primary election. and any candidate
who failg i 0 pay the amount assessed
against him for the office for which he
isB running, shall not have his name
placed upon the official ballot.
Clerk of the Superior Court, $l7 50.
County Treasurer, $17.50.
Tax Collector, $17.50.
Tax Receiver, $12.50.
Sheriff, $17.50

Section 10. The poils for said prima
ry election shall open at eight a. m.
and close at three p. m. in all precinets
axcept Marietta, where the polls shall
be opened at seven o’clock a, m. and
close at Bix p. m.
Section 11. The candidate receiving
the highest vote tor the office for which
he is running at said election shall be
declared the nominee, provided the
rules adopted by this committee are
not violated.
The following committee was ap
pointed to prepare the officiul ballot:
Colonel E P, Green, of Marietta dis
triet; Mr. W. T. Brown, of Lemons
distriet, and Mr. G. W, Wing, of Ro:=
well distriet.
Bond of Former Kennesaw
Bank Cashier Forfeited.
When the case of I'ne Sta e vs. W.
P. Whitaker, former cashier of the
Bank of Kennesaw, was called for trial
in the Superior Court lsst week, the
defendant failed to put in appearance,
and his bond was forfeited, The bond
is in the sum of two thousand dollars,
and the securnities signed thereto are
Messre. J. N. Kitchen, J. F. Brinkley,
W.. 0. Wsrdlaw, J. W. Figlder and

To be Held Fourth Sunday.
The regular meeting of the Saecred
Harp Association will take place in the
Court House, commencing at 100’clock
A. M., Sunday tne 24th day of April.
All the Sacred Harp singers, as well
as all other gingers, are urgently in
vited to attend. Bring your books and
well filled baskets,
Many good singers are expected from
Atlanta and other points, and a great
day in the history of the association is
anticipated.
While the day will be saddened by
the absence of our woithy and es
teemed President, Brother Henderson,
yat let us use our best efforts and re
joice in perpetuating the good work
which he labored 8o faithfully to
establish.
Trusting that all will remember the
day, come, and let us make it a great
success in memory of our deceased
pregident, who isB now singing those
beautiful gongs on the “Sunny Bright

Pool Room Man Fined.
Henry Meyer, operating a pool room
on Atlanta street for W. A. Gresham,
was fined $2OO in the Buperior Court
last week for a failure to pay State tax
required by law. Under the order of
the court, one-half of this amount is to
be applied to the payment of the tax,
and the other half to the court costs and
the fine.

Court and Jury Disagee As
To Righteousness of
Verdict.
In the case of The State va. David
Howaid, a white man, tried last week
in the Superior Court for a misdemen
nor, the jury returned a verdiet of not
guilty. Judge Morris evidently thought
the evidence justified a different find
ing, and did not hesitate to tell them,
“Gentlemen, I do not see how you
could have brought in a verdict like
that.”’ The members of the jury for
the most part aceepted the g(iticism
good naturedly.
Notice of Disselution.
The firm of Faw & Rogers is this day
dissolved by mutual consent. FE. 1..
Faw assumes a 11l liabilities of the
old firm, and all notes and accounts due
said firm are to be paid E. 1,, Faw, who
will continue the business as the suc
cessor of Faw & Rogers,
