By virtue of an order of the United
States District Court for the North
ern District of Georgia, sitting in
bankruptey, the undersigned will, on
the 3rd day of July, 1911, between 10
a. m. and 4. p. m., expose for public
sale before the court house door at
Marietta, Cobb county, Georgia, the
plant of the Laurel Mills Manufac
turing Co., bankrupt, described as fol
lows: :
All that tract or parcel of land lying
and being in Cobb county, Georgia,
and situated at the confluence of
Vickery’'s Creek and Chattahoochee
River, west of said creek and north
of said river, containing all told
eighty-three and eighty-five one
hundredths (83.85) acres as shown
on a map and blue print of
same made for said Laurel Mills Mfg
Co. by Robert & Marshall, civil en
gineers, in February, 1909, and made
up of fractions of the following origi
nal land lots, to wit: All of land lot
Number Four Hundred and Fifty
seven (457) lying west of Vickery's
Creek on the north bank of Chatta
hooche River, on which is located the
mills, reservoir, office and commis
sary of said Laurel Mills Manufac
turing Co., containing Eighteen and
19-100 (18.19) acres, according to said
map; all of land lot Number Four
Hundred and Fifty-six (456) lying
west of Vickery's Creek and north of
land lot Number Four Hundred and
Fifty-seven (457), containing Seven
and 34-100 (7.34) acres, according to
said map; that part of land lot Num
ber Four Hundred and Twenty (420)
described as follows: Beginning on
the north bank of Chattahoochee
River' on the dividing line between
lots Four Hundred and Fifty-seven
(457) and Four Hundred and Twenty
(420) and running thence north along
said dividing line to the northeast cor
ner of said lot Number Four Hun
dred and Twenty (420), thence west
along the north line of said land lot
a distance of Thirteen Hundred and
Fifteen (1,315) feet, according to the
scale of said map; thence due south
in a straight line to the Chattahoochee
River, thence along the mnorth bank
of said river to the beginning point,
save and except a fraction of Eight
and 36-100 (8.36) acres out of the
southwest corner of said tract, which
was heretofore sold off by said Laurel
Mills Mfg, Co., as shown on said map,
leaving a net acreage in said land lot
of Twenty-four and 44-100 (24.44)
acres now belonging to said bankrupt
company, as shown on said map; also
that portion of land lot Number Four
Hundred and Twenty-one (421), de
scribed as follows: Beginning on the
western bank of Vickery's Creek
where the land lot line between Four
Hundred and Twenty-one (421) and
Four Hundred and Fifty-six (456) in
tersects and running thence south in
said land line to the southeast corner
of said land lot, thence west along
the south side of said lot Thirteen
for the management of its property
Hundred and Fifteen (1,315) feet, ac
cording to the scale of said map;
thence due north in a straight line
to Vickery's Creek; thence in a gen
eral southeasterly direction co-inci
dent to the said ereek to the begin
ning point, but exceptinig herefrom
Five (5) certain small fractions in
said tract heretofore sold off by said
Laurel Mills Mfg. Co., as shown on
said map, aggregating Five and Sixty
eight One-hundredths (5.68) acres,
Jeaving a net acreage in said lot of
Thirty-three and Eighty-eight One
hundredths (33.88) acres belonging to
said Laurel Mills Mfg. Co., as shown
on said map. -
All of the above described real es
tate lying and being in the First Dis
trict and Section of Cobb county,
Georgia.
Also all of lot Number Three Hun
dred and Righty (380) in Milton
county, Georgia, being in the — Section
and —— District of said county, lying
east of Vickery's Creek, not hereto
fore sold off by Laurel Mills Mfg. Co,,
the said Laurel Mills Mfg. Co. having
all riparian rights to high water
mark on the east side of said creek.
Also all the water privileges appur
tenant to said lands and streams, being
all and only such as are consequent
from and dependent upon the dam
erected across Vickery's Creek on
Jot of land Number Four Hundred and
Fifty-six (456), said dam having a
clear overflow between the faces of
the abutments to same of One Hun
dred and Twenty (120) feet in width,
and said dam being in height at high
est point of crest Two and One-tenth
(2.1) of One (1) foot below the top
of an iron pin set and leaded into the
rock bluff on line with the face of
said dam, on west side of said creek
and Twenty-two (22) feet north of a
second iron pin set and leaded into
the rock bluff on the west side of said
creek, the top of said second iron
pin being on a level with the highest
point of the crest of said dam.
There being situated and located
upon the aforesaid described proper
ties all of the buildings, consisting of
mill building, warehouses, store house,
offices, ware-rooms and tenant holises
belonging to said Laurel Mills Mfg.
Co., and containing the engines, boil
ers, and cloth manufacturing ma
chinery heretofore used and owned by
said Laurel Mills Mfg. Co. in the
operation of its business.
With all the rights, members and
appurtenances to the same belonging
or in anywise appertaining,
The above described property will
be exposed for sale in two parcels, as
follows:
1. All the real property, consisting
of the land, buildings and appurte
nances thereto in the nature of the
water rights or any other easement
attached to the realty, including the
water and steam power plant, with
shafting, pulleys'and belts, and the
electric lighting plant, but not includ
ing the machinery, ete., hereinafter
described in parcel Two (2).
2. All other personal property be
longing to said Laurel Mills Mfg. Co.,
consisting of woolen and textile ma
chinery and property of like kind,
which for the purpose of this order
and sale is considered personal prop
erty. The stock of merchandise,
manufactured goods and raw mate
rial are not incluvded in this sale. If
the sale of the personal property as
above described should be made
separate from the realty, then the
purchaser thereof shall have the right
to detach and remove the same from
the realty.
After exposing the two parcels as
above described, then the entire prop
erty, including both parcels, will be
exposed for sale as a whole.
Terms—=Cash on approval of bid or
bids by the court. The highest and
best bids on the two parcels and also
the highest and best bid on the en
tire property will be transmitted to
the Court for confirmation or rejec
tion as soon as practicable after the
sale, and upon approval and payment
of the purchase price the undersigned
trustee will execute and deliver to
the purchaser, or purchasers, a con
veyance covering the above described
property. The Court reserves the
right to reject any and all bids. Title
will be conveyed free and clear of all
liens and encumbrances, except taxes
for year 1911. Detailed information
as to the above described plant and
property will be furnished on applica
tion to the undersigned.
