Notice is hereby g ven of an in

An Act to amend an Act entitled:
“An Act to authorize the mayor
and council of the ciiy of Marietta,
in the county of Cobb, to order and
have held an election by the quali
fied voters of said city to determine
whether cor not bonds shall be issued
by the city of Marietta, to be sold
for the purpose of purchasing, estab
lishing, maintaining, building: and
acquiring a system of waterworks
for said city of Marietta, and to!
authorize the issuing of said bonds,
and the assessing, levying and col-'
lecting of a tax on all property, both
real and personal, in said city o!“
Marietta for the purpose of payingl
interest upon said bonds as well as |
the principal thereof, and for thv’
purpose of creating the board ofl
light and waterworks, and making |
them a body corporate to define thcir!

PETITION FOR CHARTER
GEORGIA, COBB COUNTY. ‘
To the Superior Court of said County:
Tae petition of W. G. Liggett, of
Dallas, Texas, and C. C. Houston, of |
Lewisburg, Tennessee, shows: |
1. That they desire for t,hemsv]»i
ves, their associates, successors undi
assigns, to be incorporated and made
a body politic for the term of 20
years with the privilege of renewal
at the expiration of that time, as pro
vided by law, under the name and
style of the MARIETTA MINING
COMPANY.
2. The object of said corporation
is pecuniary gain to itself and its
shareholders,
3. The particular business in
which said corporation will engage
is:
To mine or otherwise extract or re
move gold, pyrites and al other met
als, and all cres, stone and minerals,
of whatever character or kind; and
umber, from any lands owned, ac
quired, leased or occupied by the
company, or from any other lands:
and the doing of all matters and
things incidental thereto, including
the acquiring, owning, leasing. oc
cupying, using or developing of any
lands, or mineral interest therein,
containing gold, pyrites or any other
metal, or mineral, stone or ores, of
whatever character or kind, and any
woodlands, or other lands, for any
purpose of the company; and the
buying, sclling, developing, working
and otherwise dealing in gold, py
rites and all other metals and all
ores, stone and minerals of whatever
character or kind, roadways, tram
ways, railways, electric power, water
power, acid plants, elevators, mach
inery in general, the manufacture of
sulphuric acid or any other product
made from said ores, metal or min
eral; and the marketing of all the
products of said corporation; and the
engaging in any kind of business and
the making and entering into all
kinds of contracts which may con
tribute, or be incidental, to the pro
fitable conduct of the business of

4. The capital stock of said cor
poration shall be $25,000.00, said
stock to be divided into shares of
$lOO.OO each. Ten per cent (10%)
of the amount of capital to be em
ployed by them has been actually
paid in.
5. Petitioners desire the right to
have the unpaid subscriptions to said
capital stock paid in money or prop
erty, either real or perscnal, suitable
for the uses of the corporation, tak
en at its fair and reasonable value,
or ip part cash and part property as
the stockholders may detérmine,
6. The principal office or place of
business oL said corporation shall be
pear the City of Marietta, in Cobb
County, Georgia, but petitioners de
gire that it shall have the right to
establish branch offices at other
places in Georgia and in any and a'll
States of the United States and in
any and all foreign countries.
7. Petitioners desire the right to
issue either common or preferred
stock or both, and to fix the relative
Ist‘anding and ri'ghts of the two kinds}
of stock, should both be issued.
Should preferred stock be issued, its]
standing, participation in di\'idrnds!
and terms cr conditioys upon which
it is issued and may be retired, shall
be determined at the time of its is
sue, and these shall not be threeafter
changed without the consent of zll
the preferred stockholders and a maj
ority of the common siackholders.
8. Petitioners desire that said
corporation shall have the right to
gue and be sued, to have and use a
common seal, to borrow and lend
money, to secure its borrowings by
mortgage, deed of trust, the issuing
of bonds or otherwise, and that said
corperation shall have all such other
powers as are conferred by law up
on org.nizations cf like character.
9. Petitiorers desire for said cor
peration tne power and authority to
apply for and accept amendments to
its charter of either form or sub
stance by a vote of a majority of its
stock outstanding at the time, and
that it have all other such rights,
powers and privileges and immuni
ties as are incident to like corpora
tions, or permissible under the laws
of Georga.
10, Petitioners desire that said
corporation shall have the right to
gell any or all of its property, retire
any or all of its stock, liquidate or go
out of business upor the vote of
three-fourths of all its cupital stock
outstanding, each share, whether
common or preferred, being entitled
to one vote upon such proposition.

that they may be incorporated as a
