on the first Tuesday in September
within the legal hours of sale, the

Part of land lot No. 312 in the
20th District and 2nd Section of said
County, being all the Western half
of said lot except ten and one-fourth
(10 1-4) acres of the Northeast cor
ner and being Sixty-nine and three
fourths (69 3-4) acres more or less.
Also twenty-one acres off of the
North side of the Eastern half of
larnd lot No. 311, in the 20th Dis
trict and 2nd Section of said County.
Sold as the property of J. S. Kemp,
deceased. Sold for the purpose of
distribution.

Having farmed in Cobb county for
the past twenty-two years, and for
nine years of that time represented
my district on the Board of Commis
sioners and been associated with the
business interests of the county, it
is now my ambition to represent my
county in the Legislature of the state.
The time is soon coming when the
Government will give more attention
and more money to the building of
the highways of the country, and I
feel that my knowledge of the matter
together with my past experience,
will qualify me for looking out for
the best interests of the county when
road building comes up, and that I
shall be able to do much for the
roads through our county.
I think I am fully aware of the
needs of the great farming interests
of the county, and I think the far
mers are entitled to representation in
the Legislature, and as their repre
sentative I promise to do all in my
power to promote just legislation,
as respecting both the town and the
country.
I feel that there can be no more im
portant legislation than that concern
ing our roads and schools, and I am
intensely interested in both of these.
Therefore I now take this oppor
tunity to ask for the support and the
votes of the people of the county at
the Democratic Primary on Septem
ber 11th, 1918.

the first road district, Cobb County,

reached a crisis in it’s affairs.

proximately $125,000. annually of
the taxpayvers money and in my hum

This respondent admits that he is
the editor and proprietor of the Al
pharetta Free Press, a newspaper
published in Alpharetta, and that the
same has a general circulation in Mil
ton county and other counties and
that he wrote and published said ar
ticle exhibited in said rule and that
the same was published on August
9, 1918, but this respondent says and
avers that he published the same as
a news item of the bill passed by the
legislature putting the Solicitor Gene
ral on a salary and the reference
therein to the Judge was incidental
to the news item without any inten
tion of reflecting upon the Judge or
the court, or an act of the court or
the procedure of the Court, or the
administration of the affairs of the
Court, and no criticism of the Court
was intendended or meant by this res
pondent. And if said article bears
such construction either by insinua
tion or implication this respondent
hereby wishes fully and completely
to disavow any such intention and to
apologize to the court as fully as is
in his power to do so.
SECOND
This respondent further says that
in any event he intends to publish in
the Alpharetta Free Press in the
next issue a statement signed by him
placed with equal prominence a card
disavowing any intention to reflect
either by insinuation or implication
upon this honorable Court, or the
Judge thereof, or the integrity of the
Judge thereof, and that no such thing
was meant or intended by him in
writing and publishing said article
exhibited in said rule.

At the hearing certificates under
seal of office from the various Clerks
of the Superior Court in the Blue
Ridge Circuit were produced I
which it was shown that Solicitor
General Clay had made in fees out of
kis office since January 1, 1917, when
Judge Morris went on the bench.
$7,054.72, this being much larger
sum than he would receive under the
salary bill referred to in the article.
At .the hearing Mr. Rucker was
represented by Judge Gober, and the
Court by Col. Geo. D. Anderson and
Col. J. G. Foster.
Complete retraction and apolog¥
having been made under oath by M-
Rucker, and he also stated that he
viould fully apologize for the article
in the next issue of the paper and re
tract the charge, the Court dismiss
ed the proceeding, upon Mr. Rucker
praying the cost thereof.
