I—That they desire for themselves,
their associates, assigns and successors
to be incorporated and made a body
politic under the name and style of
"James-Klngmau Lumber Company’' for
the period of twenty years.
I--The principal office of said Coro
t-any shall be in the City of Augusta, in
Richmond County, Georgia, but petition
ers desire the right to establish branch
offices within this State or elsewhere
when ever the holders of the majority
o' the stockholders may so determine.
The object of said corporation is
pecuniary gain to itself and stockholders.
4 The business to bo carried on by
said corporation is r. general lumber
business, the buying and ee’dt.g of all
Kinds of lumber and of railroad ties,
wholesale and retail, to own, operate and
lease saw mill p ants and lumber plants
for the dressing and manufacture of
lumber of all kinds: to buy and sell tim
ber rights In ar.d to ian-i, timber lands
outright, and ail such lend as may be
necessary and appurtenant to their bus
iness: to act as brokers ar.d agents in
ilia buying and selling of lumber, anti to
mske any contracts necessary thereto.
5 The capital stock of said corpora

debars, with the privilege of increasing
some to the sum of twenty-five thousand

6 Petitioners desire the right to sue
and be sued, to plgad and be impleaded,
to have and use a common seal, to m ;ke
all necessary by-laws and regulations,
and to do all other things that may" be
necessary for the successful carrying on
of said business. Including the right to
buy, hold and sell real estate and per
sonal property suitable to the purposes
of the corporation, and execute notes
and bonds as evidence of indebtedness
Incurred or which may be incurred in
the conduct of the affairs of the cor
poration and to secure the same by
mortgages or other form of lien, or
transfer of title under existing laws.
7 They desire for said corporation
the power and authority of renewal when
and as provided by tile laws of Georgia,
and that it have all such other rights,
powers, privileges and Immunities as
are incident to like Incorporations or
permissible under the laws of Georgia.
WHEREFORE, petitioners pray to be
Incorporated under the name and style
aforesaid with the powers, privileges and
Immunities herein setforth, and as are
now, or may hereafter be, allowed a cor
poration of similar character under the
laws of Georgia.

All of that tract or parcel of land,
situated, lying and being in the County
of Richmond, State of Georgia, on the
v rt side of the New fcavannah Road,
about two miles from the City of Augus
ta, containing two and one-half (214)
acres, more or less, and bounded ns fol
lows: North and West by lands of Bry
an Lawrence; East by the New Savan
nah Road; and South by the right-of
way of the Augusta Belt Railway um
pany, said land being more fully de
scribed on a plat annexed to a deed from
Bryan Lawrence to the Merchants Bank
dated February 23rd, 1909, and recorded
In the office of the Clerk of the Su
perior Court of Richmond County, In
Book 6 Y’s, pages 333-334. Said land
Is the same conveyed to the Augusta
Abattoir Company by the Merchants
Bank by deed dated January 1, 1913, and
recorded in said clerk’s office In Book
Also all of the machinery, whether fix
ed to the realty or not, and constituting
the whole or a part of the refrigerating
plant, and the machinery used in con
nection with the abattoir, consisting of
boiler, engine, run-ways, and each and
every piece or part of said refrigerating
plant and abattoir plant, located on the
said land, whether specifically herein
mentioned or not.
All of the above property will be sold
as an entirety.
And also the following personal prop
erty disconnected from said plant, viz.:
Three mules, one covered two-horse
wagon, two covered one-horse wagons,
two carts, one set of one-horse wagon
harness, one set of two-horse- wagon
harness, two sets of cart harness, one
Iron safe, three chairs, and two desks,
all located at the plant.
The said personal property will be
first offered for sale as separate Items
and then offered for sale In bulk. All of
said property is to be sold subject to
the confirmation of the Referee in Bank
ruptcy, and no bid will be accepted at
said sale unless accompanied by a certi
fied check for at least ten per cent of
the amount of the bid.
