locks.
Raising and reinforoing earth bank

Constructing masonry retaining wall
along a portion of tow path;
Paving with stone certain portions of
the oanai bank.
Surfacing and paving a portion of
Hawks Gully.
Surfacing and paving a portion of
south bank of the Savannah river from

There will be required approximately
100 cubic yards of rubble masonry; 60,000
ouWc yards of earth; 80,000 cubic feet of
brlok or concrete masonry in wall; 2,000
square yards of paving on oanai bank;

Campbell, Jones to Reynolds, on
Reynolds, Campbell to Center, on
Center, Reynolds to Bay, and on
Bay From Center to the City
Wharf, and for Other Purposes.
The City Council of Augusta Hereby
Ordains:
Section 1. That the Augusta and
Aiken Railway Company or its as
sign or successor company is hereby
authorized and empowered, under the
provisions and conditions of this Or
dinance, to construct, maintain and
operate a single track electric rail
way op the following streets of the
City of Augus'a, to-wit: On Jones
Street from McKinne Street to Camp
bell Street; on Campbell Street from
Jones Street to Reynolds Street; on
Reynolds Street from Campbell
Street to Center Street; on Center
Street from Reynolds Street to Bay
Street, and on Bay Street from Cen
ter Street to the City Wharf; to
gether with the right to connect at
McKinne Street with the line of track
now being operated by the said Com
pany or the Augusta Railway and
Electric Company on said street, ex
tending across the North Augusta
Bridge Into the State of South Caro
lina; also the right to construct and
operate such connecting line or lines
as may be necessary to enter and
leave its station or depot located or
to be located on Campbell Street with
frontages on Jones and Reynolds
Streets; provided that all other side
tracks, turnouts and sidings rights be
applied for when needed and granted
by Council in accordance with the
circumstances surrounding each ap
plication; together with the right to
operate on said line cars for freight
and passengers, propelled by elec
tricity, or power other than steam
now used or hereafter used for such
transportation purposes; also with
the right to run Its track on Bay
Street into the City Wharf so as to
receive and discharge ’ freight and
passengers thereon.
Sec. 2. That all tracks of said
railway, whether of main line, sid
ing, spurs, switches, crossings, frogs
or turnouts, shall be of latest and
most improved form and shall be laid
down in the best and most improved
mode of constructing street railways;
and the space between the tracks and
three (3J feet on both sides of the
tracks shall be constructed and main
tained in the same manner and with
the same material as that of which
the balance of the street is composed,
as provided in an Ordinance adopted
by Council September 4th, 1905; any
change of grade of said streets or of
paving material thereon by the City
of Augusta shall, without delay, be
conformed to by said railway com
pany.
Sec. 3. That the running speed of
the cars of said railway shall not ex
ceed ten miles an hour within the
City limits, under a penalty of not
less than five nor more than fifty dol
lars; and in approaching cross
streets, such speed shall not exceed
six (6) miles an hour; that in stop
ping to let off or take on passengers,
the cars of said railway company
shall not, in any way, obstruct the
streets intersecting the streets on
which said railway lines is to he lo
cated, but shall stop its cars beyond
said intersecting streets with the
rear entrance of car opposite the
crossing walk.
Sec. 4. That all laws of the City
Council of Augusta relating to the
construction, maintenance and opera
tion of street railways within the
Corporate Limits of the City of Au
gusta, now or hereafter of force,
shall be applicable to the construc
tion, maintenance and operation of
the line herein granted—especially
Section 468 of the City Code of 1898
as amended November 4t.h, 1907, and
Sections 474, 475 and 476 of said Code
and Ordinances adopted May 16th,
1900, and June 4th, 1900.
Sec. 5. That the rights, privileges
and franchises herein granted shall
be for the term of Thirty (30) years;
in consideration of which grants and
in accepting which grants the Au
gusta and Aiken Raitw-ay Company,
its successors and assigns, agree to
pav annually into the treasury of
City Council of Augusta the sum of
Sixteen hundred and sixtv-six dollars
and sixtv-six cents ($1,666,601. which
sum shall not be increased during the
term of the grant, nor shal it abate
by reason of the re-organization of
said railwav company or its consoli
dation with or mergence into a line
alreadv paying said sum; provided,
however, that nothing herein contain
ed shall be construed to affect the
liability of said Company for ad
valorem taxes or assessments other
wise provided for.
Sec. 6. That the said Augusta and
Aiken Railway Company, in accept
ing the rights, privileges and fran
chises herein granted, hereby sur
renders and relinquishes the right
and privilege to use the spur tracks
on both sides of the Confederate
monument on the 700 block of Broad
Street, known as the "Monument
Switch,” granted under Ordinance ap
proved October 14th, 1903, and
amended April 3rd. 1905—such re
linquishment to tuke effect so soon
as the tracks of the line herein

Sec. 7. That all work herein pro
vided for shall be subject to the su
pervision and approval of the Com
missioner of public Works of tbe City j

work or to make the necessary re
pairs: If such work is not done with
in the specified time, the repairs;

Sec. 8. The franchise herewith
granted to be void unless the Augusta
and Aiken Railway Company or its
assigns shall complete the construc
tion of a single track line on Jones
Street from McKinne to Campbell
Street within ninety (90) days and
the completion of the single track
from Campbell to Center on Center
from Reynolds to Bay and on Bay
from Center to Wharf within one
year from date.

per Street, From Railroad Avenue
to Young Street, and on Both Side*
of D’Antignac Street, From Camp
bell (9th) to McKinne (13th), and
for Other purposes.
The City Council of Augusta Hereby
Ordains:
Section 1. That it is necessary to
improve the foliowing sidewalks, to
wit: On both sides of Young Street,
from Estes Street to May Avenue; on
both sides of Estes Street, from
Young Street to Railroad Avenue;
on north side of Harper Street, from
Railroad Avenue to Young Street,
and on both sides of D'Antignsfc
street, from Campbell (9th) to Mo-w
Kinne (13th), by laying Cement Side
walks.
Sec. 2. That said improvements
shall be done under the terms and
conditions of an ordinance entitled,
“An Ordinance to provide for im
provement of sidewalks; laying curb
ing; assessing the cost thereof; pro
viding for the collection of the same,
and for other purposes,” passed on
the 17th day of February, 1898, and
as amended 7th day of May, 1900.

fied brick pavement on Broad street from

block or granitoid pavement on Reyn
olds street, from Fifth to Sixth streets,
and 4,250 square yards of Belgian block
or granitoid pavement on Thirteenth

A bond of five thousand ($5,000) dol
