Bath Citizens Charged
With Assault With At
tempt to Kill Constable
Wooten Were Acquitted.
Special to The Herald.
AIKEN, S. C. —George Broadanax,
colored, was tried Thursday for high
way robbery at or near Eureka.
Broadanax did not have a lawyer, but
defended himself and was acquitted
by the jury. This is the fifth time
Broadanax has been tried for a petty
offence in the court here. He has al
ways been his own lawyer and has
been acquitted each Jime.
The court of generhl sessions ad
journey Friday evening after nearly
two weeks sessions.
Friday was occupied in trying the
case of George and Will Hill and
Lula Size, charged with assault and
battery with intent to kill on Con
stable J. H. Wooton, of Bath, on the
night of March the 23rd, of this year.
From Mr. Wooton’s testimony, he
went to Will Hill’s house without a
warrant, to arrest the family for dis
turbing the peace. They resisted ar
rest, and Constable Wooton used his
pistol freely over the heads of George
and Will Hill, and then sticks and
brick bats were brought into play.
The fight corttinued to the depot, in
which the constable was stripped of
his wearing apparel. He at last suc
ceeded in subduing the offenders by
binding their hands behind their
backs with ropes. They were then
brought to Aiken on a late car, and
carried to the county jail, wherq
Jailor Vernon refused to receive
them, from the fact, that the constable
had neither warrant nor commitment
papers.
WARRANT ‘ <
HARD TO GET.
A messenger was then dispatched
to Judge William Smoak for a war
rant, but the judge refused to have
anything to do with the case. Mr.
Wooton was then in a dilemma for the
prisoners were on his hands, and he
didn’t know what to do with them.
But Chief Howard came to his res
cue and placed them in the city bat r
racks, where they remained for two
days and nights. The warrants were
at last obtained and they were re
moved to the county jail, where they
remained until Friday. After all the
evidence was heard Judge Gary or
dered a verdict of not guilty, on the
grounds that the officer violated the
law in entering a private residence
without a warrant, as the preponder
ance of the evidence clearly estab
lished the fact that there was no dls
turhance going on at the time of the
arrest. Ihe defence was ably repre
sented by Sawyer and Williams. The
solicitor prosecuted. 1
Moses Steavens, who was convicted
of arson on Tuesday for the burning
of the barn of Mrs. Carrie Mosely,
near this city, about one year ago,
was granted a new trial by Judge
Gary W. M. Smoak, and G. L. Tooie
represented Stevens.
Judge Gary left for his home in Co
lumbia Friday afternoon after hold
ing two weeks of court here.
