TOWERS ~ND ELECTRICAL CON
DUCT OKS THEREON, AND SUB
WAYS AND ELECRTICAL CONDUC
TORS THEREIN.
The City Council of Augusta Hereby
Ordains:
Section 1. That permission be, and
the same is hereby granted to the TWIN
CITY POWER COMPANY, its succes
| asors and assigns, to erect, lay, equip,
operate and maintain lines for lighting
and electric power distribution, includ
ing the necessary poles, towers, fixtures
and electric conductors, upon, along and
over the streets, bridges, alleys, lanes
and public roads of the City of Augus
ta, the necessary subways, manholes and
attribution poles, towers and electrical
conductors, as its business may, from
time to time, require; and the right
to sell, rent or license the use of space
on said poles, and towers, and in said
subways, for the same or similar pur
poses, to persons or corporations having
lawful authority to operate in the City
of Augusta. This grant is made upon
tile terms, conditions, limitations and
provisions in tills ordinance set out.
All poles and towers shall be neat
anu symmetrical, and no electrical con
ductors shall be placed less tnan twenty
eiglif <3B) feet above the surface of the
ground, unless special permission be
given in writing for each case by the
Superintendent of Kire Alarm and Police
Telegraph, when they may be as low
as twenty-two (22) feet. Within the
area wherein subways may be laid, no
poles or towers, except terminal poles
or towers, to be used for distribution
from tlie underground system shall be
erected and maintained on the streets.
Within such area not more than two
terminal poles or towers shall be erect
'd ami maintained on any one block of
the streets.
Section 2. That the said poles and
towers and said subways shall be con
structed and maintained by said com
pany, its successors and assigns, in a
good thorough and workmaplike man
ner, ‘and according to the laws of the
State of Georgia and of the City of
Augusta now in force or that may be
hereafter adopted. Before laying down,
constructing and equipping of said sub
ways, the said company shall tile with
the Commissioner of Public Works of
Augusta, complete detailed plans and
specifications, showing the exact loca
tion of the subways and appurtenances
along the highways, and the depth there
of; and no woik shall be begun until
;he Commissioner of Public Works has
notified said company, In writing, of his
approval of such plans and specifications
and locations. If the work shall have
been done contrary to the adopted plans,
specifications and locations, the said
company shall immediately, upon receiv
ing written notice from the Commission
er of Public Works, or from the Mayor,
remove the said subway or other ap
purtenances or make tm- same conform
to such plans, specifications and loca
tions; and if it should fail to do this im
mediately. then the City Council shall
have the right, through Its officers or
employes, to remove the same at the
cost and expense, of said company, its
successors or assigns.
Section 3. That the work of putting
down the underground subways anti
drawing the underground cable wires
and electric conductors in said subways,
and the work of erecting the poles and
towers and overhead wires shall be done,
from time to time, as the business of
the company demands, under the super
vislon of the Commissioner of Public
Works. The area in which subways
shall be constructed shall be *from the
South side of Bay street, including
Reynolds, Broad, Ellis, Greene, and) Tel
fair streets to the south side of Wal
ker street, ’ and extending from Seibert
(Fourth) street, on the east, to McKinti©
(Thirteenth) street, on the west, such
area to be extended and Increased when
ever council may deem it advisable so
to order.
Section 4. That the work of erecting
poles and towers and opening streets,
alleys, lanes and nub’ic roads by virtue
of this ordinance, shall be done under
the supervision of the Commissioner of
Public Works of Augusta, and the Su
perintendent of Fire Alarm and Police
Telegraph of the City of Augds x; and
the said company shall replace and prop,
oily relay any sidewalks or street that
may be -Cured or displced by reason of
the erection of such poles or towers, or
the opening of such streets for subways;
and, upon failure of the company to oo
so within ten 1 10) days after notice in
writing given by the Commissioner of
Public Works to said company, the City
may repair suen portion of the sidewaui
or Street that may have been disturbed
by said company, and collect the cost
from said company. Not more than one
thousand (1,000) lineal feet of street
on any one street shall be opened or
be permitted to remain open at one
time, and no street opened shall remain
uncovered for more than one week, ex
cept by special written permit from the
Mayor or Commissioner of Public
works; and such openings shall at all
time# be protected in compliance with
the ordinances of the City of Augusta
now In existence or that may be passed.
Section 5. That the pressure or the
electric current carried on any of tile
wives of the overhead construction shall
not exceed tthirty-three hundred (3,300)
volts, and the pressure shall not ex
ceed thirty-three hundred (3,300) volts

Section 6. That if at any time there
should come Into existence any defect
In such poles, towti's, wires or sub
ways. or other appurtenances, that are,
or 'may be, injurious to the public, the
said companv shall be, and Is hereby
required to promptly correct the same
upon receiving written notice thereof
from the Commissioner of Public Works
or „ie Superintendent of Fire Alarm and
Police Telegraph. Upon failure on the
port of said company to correct such
defects. The City Council of Augusta
shall have the right to correct the same
at the expense of said company. Its suc
cessors or assigns.
Section 7. Thut In erecting such poles
or towers, or tn laying down, construct,
ing or equipping said subways, and the
appurtenances thereof, if it should be
necessary to remove any water pipe, gas
pipe, sewer, drain, or any outer pipes,
drains or structures, sucli removal shall
be done at the expense of said com
puny. If at any time thereafter It may
become necessary to remove such poles,
towers or subways or other appurte
nances. for the purpose of laying down
any sewer, water pipe, gas pipe, or oth
er public utility, the said poles, towers
and subways, or other nppurten.'_r\ces,
shall be subject to removal so as to per
mit the construction of the desl-ed 6ew.

objects to such removal, It shall not be
required unless the City Council shall
have first determined that it Is neces
sary.
Section S. That before beginning the
erection of such poles or tower*, dr the
laying down, constructing or equipping
of said subways the said company shall
enter into the bond required by Section
256 of the City Code, as amended by
the ordinance of September 5. 1599.
Section 9. In consideration of the
rights and privileges herein granted, the
said company shall provide one cross
arm on each pole or tower, when so
requested by the City and space not to
exceed one uuct in the said subway sys
tem, for the free use of the Police and
Fire Alarm system of the City of Au
| gnsta.
I Section 10. All underground conduits
and manholes put down, and poles and
■ towers erected, or used, under thia or-
dinance are to be owned and controlled
by the Power Company-, its successors
and assigns, for their own use except
for such use as the City of Auguoia has
reserved for its Police and Fire Alarm
wires; and no wires or cables of any
other company are to be placed in said
ducts, or on said polgs, without the con
sent of the Power Company, its succes
sors and assigns.
Section 11. That all work done under
and by virtue of this Ordinance shall
he done under the resolutions, laws and
ordinances of the City of Augusta at
the time the work is done, and said
Company, shall at all times be subject
to the resolutions, laws and ordinances
of tne City of Augusta, now in exist
ence or that may hereafter be passed,
relative to the use of public streets,
lanes and alleys of the City of Augusta
by lighting or power companies having
wires over or unuer the streets of Au
gusta. This Ordinance does not, and
shall not be construed to, repeal or
amend an ordinance passed November 4.
1901, entitled, "An Ordinance to Re
quire all Telephone, Telegraph and Elec
tric Light Wires of all Kinds, EXbept
the Trolley and Feed Wires on the Elec
tric Car Line, on or over the streets
of Augusta, Within the Fire Limits, to
be placed Underground and for Other
Purposes.”
Section 12. That a condition of this
Ordinance is that said Company shall, in
laying, constructing and equipping such
subways, make mem of sufficient capac
ity to accommodate twice the business
that said company now has.
Section 13. That said Company shall
Indemnify and hold harmless The City
Council of Augusta against all claims
for damages, whether to person or prop,
erty, that my be successfully inserted
against it. by reason of the Construct
ing, equipping or maintaining of any
poles, towers, fixtures, electrical conduc
tors, subways, man-holes, distributing
poles, towers, or other appliances or ap
purtenances authorized by this ordl
nance; or by reason of any wrongful,
illegal or negligent act on the part ol
said Company or its employes. In
event of suit being brought against The
City Council of Augusta by reason of
any of the above named acts, and writ
ten notice being served upon said Com
pany of such suits, the said Company
shall come in and defend said suit at its
expense, and shall be bound by any judg
ment that may be finally obtained
against The City Council of Augusta,
but no judgment shall be deemed final,
pending any undetermined appeal there
from.
Section 14. That the rights, privileges
and franchises granted by this ordinance
shall continue for FIFTY (50) years from
the date hereof.
Section 15. That said Company, its
successors, lessees and assigns, shall be
subject to all license and occupation
taxes, and all advalorem taxes upon its
property and franchises lawfully im
posed, in the same manner as all other
property, real and personal, in the City
of Augusta is subject to taxation. Said
Company shall further make no higher
charge to persons or corporations in the
City of Augusta than is charged by said
Company to consumers to ahy other
point.
Section 16. Said Company. Its succes
sors, lessees and assigns shall comply
with all present and future laws of this
State and ordinances of The City Coun
cil of Augusta, and for failure to carry
out in good faith any of the require
ments of this ordinance, or of any ftk
ture ordinance that may be enacted, not
in conflict herewith, it shall be deemqd
guilty of a violation of this ordinance
or of such future ordinance, and, upon
conviction, shall be punished for such
violation, as may now or then be pro
vided by law.
Section 17. Said Company shall file
with the Clerk of The City Council of
Augusta, its acceptance of this ordi
nance within thirty days from its date,
in order to make the same valid.
Section 18. The rights, privileges and
franchises granted under this ordinance
shall be void, unless said Company shall
commence the actual installation of its
distribution system within the corporate
limits of the City of Augusta, within
three years from the date hereof.

HOLD INSTITUTE
The Town is Entertaining
the Guests Royally. Many
Farmers are in Attend
ance.
TIGNALL, Ga.—The Farmers Insti
tute opened at Tignall at 11 o’clock
Wednesday. There was a large at
tendance of farmers. Captain R. J.
Redding of Griffin made an address
on "Diversification and Rotation of
Crops.” Capt. Redding dwelt on the
importance of business as a sign and
seal of fertility.
After a recess the farmers came to
gether in great numbers. There is a
great deal of interest shown in this
occasion.
The master of ceremonies, Mr. J.
A. Moss, is assisted by Mr. C. D. Bol
ton, Sheriff W. O. Bobo, and other
gentlemen of the neighborhood. The
whole town is wid e awake, and the
doors are all thrown open and every
thing is favorable to a good time and
profitable institute.
Moonlight River excursion and

AT THE CASINO
Patrons of the Cosino free show
this week have enjoyed a really ex
cellent performance.
The Graham Sisters put on a nice
song and dance specialty. Their
“Mexico” song was particularly bright
tuneful and catchy. They dance well,
smile in a winning wav, and their
voices are both clear and pleasant.
Miss Betsoff, who sings illustrated
songs, has one of the clearest voices
heard on local vaudeville boards this
season. Her songs are new and tune
ful, and illustrated with beautiful
slides.
The motion pictures are changed
every evening.
