I Walter Russell GuUty of Volunta ry Manslaughter. Yesterday morning the case of the State vs. Walter Russell, ac cused of murder, was taken up in the Superior Court, Judge Turn bull preseding. Solicitor Joe Nunnally repre sented the State while Henry A Wright appeared for the defense. • The evidence in the case was not complicated nor long, and it was i all before the jury by the recess hour for dinner, 12:30. Solicitor Nunnally spoke eloquently for the ' State and his arguments were logi cal. Judge Henry made a technical speech to the jury which went to prove that Russell, when he stabbed Ray, he was acting upon the fears of a reasonable man and should be acquitted. The defense closed having intro duced no evidence but the defend ant’s statement, with a very fine effort on the part of Hon. Seaborn Wright. He made a great impres sion upon the jury and during one of his eloquent flights, one of the jurors exclaimed lustily: “you are right Seab, he is not guilty !’’ The judge charged the law late yesterday afternoon in a succinct and clear form. The jury after being out all night returned the following verdict:'- “We the jury find the’defendant guilty of volun tary man slaughter and recommend him to the mercy of the court ” Judge Turnbull, delivered a most impressive talk to Russell and among other things he said was, “that character counted a great deal with him when he sentenced those who had been found guilty by the jury. In this instance it represented eighteen years. Hie Honor then imposed a sentence of three years in the penitentiary upon Rnssell. This morning tie case of the State vs. Tom and Dick Wash 6run, was called. The Washbrun beys are accused of simple larce my W. E. Hirvey is the pros°cu tor. It is alleged that the defen dants “feloiously, maul iciously and with force o f arms did take and carry away from a pen two ‘hogs with intent to s f eal the same against peace dignity laws of the State” Both defendants are white Judge George Harris represents the Wash brun bovs. The jail cases will ell be tried his week, if possible. Ou nex’ Saturday tie court wiil take a re cess untill the second Monday in October. BOAT EXPLOSION. Five Sailors Scalded on The Eric son. Some may Die. New London, Conn. July 18.— Five sailors on the torpedo boat, Ericson, were terribly scalded by ’ a bursting steam pipe while the boat was cruising in the harbor at ) 1 p in. They were taken to the Sailors’hospital herejand it is be lieved some of them will die. The injured men are: Austin Williams, New York ; Joseph Ham ilton, New York City; David Co dy, Jersey City; Wm. The band will give a concert and the evening will be most pleasanl y spent. The people of Rome should work together for the success of temper ance convention which meets here on July 31st. We ought to bid the go id people to our city a cheerful welcome. Reduced rates have been secured on all the roads ami a large crowd will certainly be present.
