Moat of shots struck the Chief, but he fortuntely, carried a large pocket-book in the breast pocket coat which protected his heart from the a-sassin's builets, and he was not seriously injured. Ziegenball was promptly arrest ed and confessed that, his motive in attempting to kill Chief Brett sehueider was revenge for what he regarded as wrong'ul dismissal by that officer srom the p -lice.force. : IN MEMORY Mrs. R. He commenced by stat ing that he would at once enter up on consideration of thh testimony without any introduction. • He referred to April 3d, and said j that he would consider the twol leading characters in the tragedy. One wa& the young man who had borne an unsullied reputation and who bore it still. There was noth-1 ingin the testimony, he said, which could be based as a single motive for the crime. The young lady was also of unimpeachable character and there was nothing to show any undue intimacy between her and the defendant. Their conduct to gether was perfectly natural. Durrant’s actions upon the eve ning of the third of April were per fectly natural. He told Miss La mont’s aunt about riding with her and also tha* he had promised her a book, and on the following Fri day took the book to her home. That was rot the action of a guil ty man. Durrant’s attendance at Dr Cheney’s lecture was proved by I the testimony of every witness on 1 that point. By the testmony of Dr. Cheney n roll call was kept and it was call ed after the lecture and he believed it to be correct. No testimony could be more direct. Counsel also argutd that the testimony of Dr. Gray, who kept the roll, showed conclusively that the book was re liable. It was undoubtedly the piv otal point of the case and if it was correct, the proscsecution had fail ed in ever other point.
