It took Judge Murphy a little over an hour to deliver the charge which was coid and impartial,’and then amid suppressed excitement, the jujy filed out. ON FIRST BALLOT. The jury took the first ballot, which was for murder in the first degeee. Word was sent at once to the court and Judge Murphy sent for tqe jury. AVI ile this was going on Durrant sat in the court room beside his counc el conversing with his mother and several of her lady friends. As soon as Mrs. Durran*’, the mother, learned that the jury was coming in her demeanor changed from one of granty and a look of dread came over her face which was not reflected, in that of her son. The cries' that went up from them f»P upon the ear of the convicted murderer's mother liken blew and it brought her the first realization of the force of the words of the foreman. Her fa -e was averted as she had n»rved her self for the ordeal, but though possessed of marvelous courage, a cry burst from her lips, followed by a hysterical outburs of s bs. BENNETT-WILSON. Squire John Rice, of Rice’s Spring, was in the city and while here filed the proper returns for the latest wedding escapade down in his neck of Che woods. The high contracting parties were John Bennett and Miss Kathrin Wilson, ex-inmates of the Alms house, who though late in life, became victims of lifes usual romance. At torney Rotan announced to the court that the defense had decided to let the Holmes case go to the jury as it had been made out by the commonwealth, the defense introducing no testimony After this announcement the court ad journed for the day. Th« concensus of opinion Inst last night and this morning seem ed to be that Holm>.v would be ac quitted. Nine out of every ten persons questioned on the subject, law yers or laymen, agreed that h e ought to hang on general princi ples, enough crime having been been fastened upon him, but that the murder of Pietzel had not brought home to him beyond a reasonable doubt. Even bets were being freely made last night on hie acquittal. When the jury filed into th»» court a moment after ten o’clock this morning they looked tired and unkempt, and there was a thin growth of beard on every cheek.
