The hearing was progressing ap parant;y in a smooth manner un til Mr. Lytle’s counsel wished to I amend tbei-application so as to indue the Cave Spring ro»d in the property claimed by Lytle et al. The deed to said property was not in evid nee so the hearing could not. be proceeded with . Judge Henry continued the case until next Monday night when it will be taken up again. After this Capt. R. A. Denny of Reece & Denny who represent the City Electric Railway Com pany procured the deed fiom Messrs. Glover and Hight, who have a mortgage on the property, and read it very carefully. The instrument conveys all the property “except the Cave Spring road. ” This seems to be a clincher for the City Electric Railway Compv »y- It is sincerely hoped that the laudable effort of the company to give Rome a summer resirt will not be .
