REVERSAL: The fourth Cir
cuit Court of Appeals reversed the
decision of a lower Federal Court
in the case of Harvey B. Gantt di-
recting his admission to Clemson
College at the beginning of the
next semester. The lower Court
ruled in December that Gantt’s At
torneys had failed to prove that
he had been denied admission to
Clemson because of his race. Clem
son contended that the lowa State
sophomore had not met its en
trance requirements. The argu
ment of Gantt’s attorneys was that
when one requirement was met
others were added. The lower
Court ruled that South Carolina
discouraged but did not prohibit
Negroes from entering formerly
all-white institutions. The distinc
tion between discouragement and
prohibition a novel device in legal
language was not acceptable to the
Court of Appeals and probably the
note that encouraged the reversal.
A possible appeal to the Supreme
Court may still delay Gantt’s en
trance. But whether a stay is
granted before February first,
date of Clemsons second semester,
is the doubtful note in the matter.

gro Attorney General. Brooke, a
Republican, was sworn in by
Massachusetts Governor, Endicott
Peabody, a Democrat. It was the
first time a Negro was ever elect
ed to a state-wide office ... At
Deerfield Beach, Florida, twenty
