Green, Sr. (who is dead ) made their mortgage deed, of that date, con veyed Mfc-our petitioner lot of land, No. 145. in the JroPn District of formerly Lee, now said County of Schley, to#>ecure the payment of a promissory note by them made payable to petitioner for £BBO, due the 25th of December then next. That soon after the deatli of said John J. Green, Sr., who died seized and possessed of said land, one Aaron Ilart went into possess ion of the same, and became the Executor of said Green, and petitioner says that said note has never been paid. Whereupon he prays a rule calling upon said Charles 11. Green and Aaron Ilart, Executors of said John G. Green. Sr., to pay the principal and interest on saiit note, into this court, or in default the Equity of redemption be foreclosed. 11. K.
