AN IMPORTANT DECISION IS
HANDED DOWN BY THE

is not liable for the personal effects
of its passengers in (he ordinary
sense that a hotel would In- for the
property of its guests, ii must exer
cise reasonable >; recaution in pro
tecting such passengers’ property.
This issue was decided Friday
morning in a decision handed down
in the supreme ourt in the case of
the Pullman Company vs. Sehaffner.
On tiie evening of August 23. 1003.
P. K. Sehaffner bought a Pullman
berth in Augusta for Atlanta, lie
set up that no conductor was aboard
the sleeiK-r. and that it was/look.'d
after only i.y the negro porter.
When Sehaffner awoke the next
morning a two-darat diamond, val
ued at S3OO. a S2O hi)!, $3.15 in sil
ver and two razors, valued at SO.
were missing. Sehaffner brought suit
against the company for damage. On
trial of the cake the Pullman Com
pany moved a non-su'! on/the ground
that Sehaffner had not proven that
he had the property wheel he got on
the car. nor had he movon negli
gence on the f,art of tlif- company.

appealed and the supreme court sus
tained the lower court
