Election to be held on Tuesday,
Nomember 8, 1938, amending Ar
ticle 7, Section 7, Paragraph 1, of
the Constitution of the State of
Georgia, authorizing the City of
Adel to incur a bonded indebted
ness in addition to that heretofore
authorized by the Constitution and
laws of Georgia for the purpose of
refunding and retiring its existing
bonded indebtedness due and un
paid as of July 1, 1937 and which
becomes due up to and including
July 1, 1942; to provide that the
funds raised from such additional

WHEREAS, The General Assem
bly nt the 1937-38 extraordinary
session proposed an amendment t >
the Constitution of this State as
set forth in a resolution approve I
January 10th, 1938, relating to the
bonded debt of Adel, to-wit:
AN ACT
No. 128
An Act to propose to the quali
fied voters of Georgia an amend
ment to article 7, section 7, para
graph 1, of the Constitution of
Georgia, so as to authorize the City
of Adel to incur a bonded indebt
edness in addition to that heret >-
fore authorized by the Constitution
and laws of Georgia for the pur
pose of refunding and retiring its
existing bonded indebtedness due
and unpaid as of July 1,
1937, and w'.’ich becomes due
up to and including July
1, 1942; to provide that the
funds raised from such additional
bonded indebtedness shall be used
exclusively for the retirement of
said bonded indebtedness that is or
may become due and unpaid as of
July 1, 1942; to authorize the City
of Adel to increase its bonded in
debtedness, in addition to and
separate from the amount of debts
heretofore allowed under said
paragraph, under certain circum
stances, for the purpose of extend
ing, enlarging, repairing, con
structing and maintaining the
waterworks, sewerage, and electric
systems of the City of Adel: Io
provide for the submission of the
amendment for ratification by the
people; and for other purposes.
Section 1.
Be it enacted by the General As
sembly of the State of Georgia,
and it is hereby enacted by the au
thority of same, that article 7, sec
tion 7, paragraph 1, of the Consti
tution of Georgia which has here
tofore been amended shall be fur
ther amended by adding at the end
thereof a new paragraph in the
following words, to-wit:
“And except that the City of
Adel may issue refunding serial
bonds not in excess of the aggre
gate sum of thirty-nine thousand
($39,000.00) dollars for the purpose
of refunding and retiring its ex
isting tended indebtedness due am!
unpaid as of July 1, 1937 and which
becomes due up to and including
July 1, 1942, and providing for the
assessment and collection of an
annual tax sufficient in amount to
pay the principal and interest of
said tends as they fall due; the
proceeds of all such refunded
tends so issued by the City of
Adel to be used exclusively for the
purpose of paying and retiring
said bonded indebtedness that is
or may become due and unpaid as
of July 1, 1942. Said refunding
tends shall be issued when author
ized by a vote of the Mayor and
City Council and shall be validat
ed as provided by law: that the
City of Adel from time to time as
necessary for the purpose of ex
tending, enlarging, repairing, con
structing and/or maintainin'’,
(either, any or all of them) its
waterworks system, sewerage sys
tem and electric light and pow >
system, including pipe lines, res
ervoirs, pumping stations, sewer
age line, sewerage disposal plant,
electric line, machinery and ma
chinery replacements, or anythin:
else that may be necessary, con
venient or proper for the extensi
on, enlargement, repairment con
struction. maintenance and or or •
eration es the waterworks, sewer-
age and electric light and power
systems of the City of Ade), may
incur a bonded indebtedness, in
addition to and separate from th 1
amount of debts hereinbefore in
this paragraph allowed to be in
curred, to an amount in the ag
gregate not exceeding the sum of
twenty-five thousand ($25,000.00)
dollars, and such indebtedness not
to be incurred except with the as
sent of two thirds of the qualified
voters of said City, voting at an
election or elections to be held as
may now or may hereafter be pre
scribed by law for the incurring
or new debts by said City of Adel.
Provided said two thirds so voting
shall be a majorty of the regist
ered voters.’’
Section 2.
Be is further enacted by the au
thority aforesaid, that when said
amendment shall be agreed to oy
two thirds vote of the members of
each House, with the “ayes” and
“nays” thereon, and published in
one or more newspapers in each
Congressional District in this State
for two months previous to the
time for holding the next general
election, at which proposed amend
ments to the Constitution of this
State may be voted on, and shill
at said general election bo submit
ted to the people for ratification,

in favor of adopting the said pro
posed amendment to the Constitu
tion shall have written or print
ed on their ballots the words, “For
ratification of amendment of ar
ticle 7, section 7, paragraph 1, of
the Constitution, authorizing the
City of Adel to issue refunding
bonds, to increase its bonded in
debtedness for waterworks, sewer
age and electric system,” and all
persons opposed to the adopting of
said amendment shall have writ
ten or printed on their ballots the
words, “Against ratification of
amendment of article 7, section 7,
paragraph 1, of the Constitution,
authorizing the City of Adel to is
sue refunding bonds to increase its
bonded indebtedness for water
works, sewerage and electric sys
tems.” Ar.d if a majority of the
electors qualified to vote for mem
bers of the General Assembly, vot
ing thereon, shall be consolidated
as now required by law in election
for members of the Genera! As
sembly, the said amendment
shall become a part of ar
ticle 7, section 7, paragraph 1, of
the Constitution of the State, and
the Governor shall make a procla
mation therefor, as provided by
law.
Section 3.
All laws and parts of law:-, con
flict herewith are hereby repealed

WHEREAS, The Genera] Assem
bly at the 1937-38 extraordinary
session proposed an .amendment to
the Constitution of this State as
set forth in a resolution approved
January 10, 1938, re.ating to the
bonded debt of Baxley, to-wit:
AN ACT
No. 135.
An Act to propose to the qualifi
ed voters of Georgia an amend
ment to article 7, section 7, para
graph 1, of the Constitution of
Georgia, so as to authorize the City
of Baxley, Appling County, Geor
gia, to refund a bonded indebted
ness, in addition to that hereto
fore authorized by the Constitution
and laws of Georgia, for the pur
pose of refunding and retiring its
present or any future bonded in
debtedness legally incurred that
mav he due and unpaid, provided
that same shall not be in excess
of the amount municipalities are
now authorized to incur, and pro
vided that the funds raised from
such additional bonded indebted
ness shall be used exclusively, and
for no other purpose, for the re
tirement of said bonded indebted
ness that may exist for the pres
ent time or in the future, and to
provide for same as may become
due or unpaid, and to mithorize
the governing authorities of the
City of Baxley, without a vote of
the people, to authorize the issu
ance of said refunding bonds to
meet the present or any future in
debtedness that may be incurred,
and to provide for the submission
of thia amendment for ratification
by the people; and for other pur
poses.
SECTION 1.
Be it enacted bv the General As
sembly of the State of Georgia,
and it is hereby enacted by au
thority of the same, that article
7, section 7, paragraph 1. of the
Constitution of Georgia, which has
heretofore hern amended, shall bo
further amended by adding at the
end thereof a new paragraph in
the following words, to-wit:
“And except that the Citv of
Bax’ey, in Appling County, Geor
pi't, for its present or future bond
ed indebtedness, ^nay issue serial
refunding bonds not in excess of
the legally authorized outstanding
unpaid bonded indebtedness, which
includes principal and interest,
for the purpose of refunding and
retiring any bonded indebtedness
for said City of Baxley municipal
ity. and providing for the assess
ment and collection of an annual
tax sufficient in amount to pay the
principal and interest of said re
funding bonds as they shall fall
due: the proceeds of such refund
ing bonds that may be issued as
herein p ovided to be used exclu
sively for the purpose of paying
and retiring said bonded indebt
edness that is due or that may be
come <lue and unpaid on any fu
ture bonded indebtedness, and pro
vided further that said refunding
bonds shall lie issued only’ when
authorized by a vote of the gov
erning body of the City of Baxley,
and then shall be validated as is
provided by law ”
SECTION 2.
Be it further enacted by the au
thority’ aforesaid, that when said
amendment shall be agreed to by
two-thirds vote of the members of
each House, with the “ayes” and
“naves” thereon, the Governor is
hereby’ directed to have this pro
posal published in one or more
newspapers in each Congressional
District in this State for two
months previous to the time for
holding the next genera! .lection,
at, which proposed amendments to
the Constitution of this State may
be voted on, and shall at said gen
eral election, be submitted to the
people for ratification. All per
sons voting at said election in fa
vor of adopting the said proposed
amendment to the Constitution
shall have written or printed on
their ballots the words, “For rat
ification of amendment of article
7, section 7, paragraph 1, of the
Constitution, authorizing the City’
of Baxley to issue refunding
bonds,” and al! persons opposed to
the adopting of said amendment
shall have written or printed on
there ballots the words “Against
ratification of amendment of ar
ticle 7. section 7, paragraph 1, of
the Constitution, authorizing the
City' of Baxley to issue refunding
bonds.” And if a majority of the
electors qualified to vote for mem
bers of the General Assembly, vot
ing thereon, shall vote for ratifi
cation thereof as provided by law,
the result shall he consolidated as
now required by’ law in election
for members of the General As
sembly, the said amendment shall
become a part < f article 7, section
7, paragraph 1, of the Constitution
of the State, and the Governor
shall make a proclamation there
for as provided by law.

District of Berrin County, Georgia,

paid as of October 15, 1938, and
which becomes due up to and in

the Constitution of this State may
be voted on, and shall at said next
general election be submitted to
the people for ratification. All

ification of amendment of article
7, section 7, paragraph 1, of the
Constitution, authorizing the Beav

Said refunding bonds shall be is
sued when authorized by a vote of
the mayor and town council, and
