GOP HAS NO CHANCE CAP
TURING CONTROL OF SENATE
The Democratci majority in the U.
S. Senate, which has not been upset
since the beginning of the 73rd Con
gress, in 1933, will be easily main
tained in the next (79th) CongresH,
declared Senator Joseph C. O Ma
honey (Democrat, Wyoming), chair
man of the Democratic Senatorial
Campaign Committee, at a recent
press conference at the Democratic
National Committee Headquarters m
the Biltmore Hotel.
“Os the 36 seats to be filled this
year, the Democrats need to win only
14 to retain their majority," he said.
“It is a mathematical certainty that
the Senate will remain Democratic.
Senator O’Mahoney added that the
election of Democratic Senators
seemed certain in North Dakota, Ari
zona, California. eKntucky, Maryland,
Oklahoma, Utah, Washington, New
York and Illinois, and probably in
Massachusetts, Rhode Island, Connec
ticut, New Jersey and Idaho.
The Wyoming Senator said he was
sure Governor oJhn Moses of North
Dakota would defeat Senator Gerald
P. Nye, Republican, who won nomi
nation in a close primary contest, and
that Senator Alben W. Barkley would
win in eKntucky.
Referring to the presidential cam
paign, Senator O’Mahoney said his
trips through the country had con
vinced him that desire for a perma
nent peace was uppermost in the
minds of the American people.
“They know that President Roose
velt and Secretary Hull have been
working untiringly for such a peace,”
he said. “The people are not going to
take any chance on anybody else.”

Our lives have gone miraculously
on in an almost even line—of practi
cal comfort and security. We have
lacked neither clothing, food nor
work. We have the greatest Navy,
Army and Air Force in the world.
What we lack is gratitude or the
common decency to give credit where
credit is due. And because we have
these blessings in a world that is a
howling wildderness without—we
carp, complain and criticize and arc
eager to beat down the hands that
built up this miracle of production
and planning which has forged our
weapons of resistance to the enemy.
Can we thank Colonel McCormick,
Senators Wheeler and Nye, Repre
sentative Ham Fish, Mr. Spangler
Mr. Shroeder, Mr. Hoover, for al'
t is? Or even Mr. Dewey?
This despised administration, which
replenished banks, built our roads
filled empty houses and stomachs
hasn’t done so badly in this war; and
many Republicans seem to forget

GEORGIA AMENDS
FREIGHT RATE SUIT
IN SUPREME COURT
Governor Ellis Arnall has strength
ened Georgia’s suit in the United
States Supreme Court against rail
roads operating in this territory,
seeking redress for freight-rate dis
criminations, by amending the state’s
petition for recovery of damages to
ask a total of $16,750,000.
The amended petition has been
filed in the office of the clerk of the
Supreme Court in Washington.
The complaint now is broken lip
into four counts. Under these, the
States sues in “its capacity as a sov
ereign to safeguard the performance
of the obligations of government with
which as a State of the Union it is
charged."
Furthermore, the State sues in its
capacity as “an agent and protector
of its people against a continuing
wrong done to the people of Georgia
as an organized community in their
lives, liberties and estates.”
Third, the State is suing in its ca
pacity as a proprietor, “against
wrongs suffered by and damage done
to the State as owner of a railroad"
and “as the owner and operator of
various institutions maintained by the
State.”
Fourth, it sues in “its capacity as
protector, and in behalf of a large
general class of its citizens who by
necessity are required to ship over
the defendant railroads and have
been damaged by the acts of which
complaint is made herein.”
