The BANKS COUNTY NEWS is the designated legal organ for Banks County, Georgia. All
required legal advertisements will be published in The Banks County News each Wednesday.
Deadline for publication is NOON ON WEDNESDAY prior to the following Wednesday’s issue.
Items submitted after the deadline, including Foreclosure Notices, Public Hearings, Public Notices
and Advertisement for Bids, that must publish the following week will be charged a $25 LATE
CHARGE. Notices submitted after noon on Thursday that must publish will be subject to a $50
LATE CHARGE. Other legal notices will not be accepted after the Noon Thursday deadline and
no advertisements of any kind will be accepted on the following Monday.
The deadline to cancel legal advertisements is 2 p.m. ON FRIDAY prior to the next
Wednesday's issue.
The types of legal advertising carried include: petitions; divorce; notice of debtors and credi
tors; citations; trade names; adoptions; name changes; foreclosures; articles of incorporation;
bids; estates; and public notices.
Most rates for legal notices are as follows: $10 for each 100 words or portion thereof for each
insertion.
For billing purposes, every word shall be counted as one word including words such as: the,
of, a, etc. Grouped numbers shall be counted as one word.

The following are some of the more common types of legal notices
run in this newspaper:
INCORPORATION NOTICE — These are notices that a business is being incorporated with its
office located in the county. Related incorporation notices can include intent to dissolve a corpora
tion; name change of corporation; and mergers of corporations.
NOTICE OF NAME CHANGE - Name changes must publish for 4 weeks in the legal section of
the paper. As soon as you file with the Clerk of Court, bring or fax notice to the paper, as they must
publish within a 30 day time frame from the filing date.
NOTICE OF SALE / FORECLOSURE NOTICE — These notices are usually run when some
one, generally a financial institution, has not received payment on a loan. Property which secures
the loan is being foreclosed on so the lender can take it to sell or otherwise pay off the loan.
HEARINGS & MEETINGS NOTICES — There are a wide variety of public meetings which must
be held in order for a government to take an action. Among the most common are notices of
planning commission meetings at which rezoning requests are to be acted upon and of hearings
when a city or county government is setting its budget and tax rates. Sometimes, governments
are required to publish notices about upcoming meetings, especially when a meeting is to be held
outside the regular schedule of that government.
ESTATE NOTICES — There are some 20 different types of estate notices that can be published,
the most common of which is a notice to creditors to let the court know if a deceased person owes
them any money. Most estate-related notices come from the county probate judge’s office.
NOTICE OF ELECTIONS AND REFERENDUMS — This covers a wide range of issues, from
notices to hold elections on alcoholic beverage sales to notices on bond referendums to construct
school buildings. Notices must also be run about upcoming city and county elections when candi
dates are running for public office.
BID NOTICES — When a local government is going to buy something or have work done on a
project, it is often required to solicit bids via legal notices. A related area of legal notices involves
the sale of surplus government owned equipment, which must also be listed and published.
NOTICE OF GOVERNMENT FINANCIAL RESULTS — Most city, county and school government
agencies are required to annually publish the results of their audits. The amount of detail required
varies by government.
