The German Village attorney de scribes Village Drive as “a minor road identified as a part of German Village subdivision. In certain county docu ments it has been described as a “light duty” road, although such a road does not seem to be defined anywhere in County ordinances. It is the only means of ingress / egress into the sub division and is identified in the Glynn County Code, Chapter 2-15, Traf fic Control, 2-15-3 as extending from Lawrence Road to end of pavement for a distance of .42 miles.” White notes that “...the County first paved the road sometime in the 1990’s and has never exercised juris diction or control over the unpaved portion of the lane which extends be yond the end of pavement to a fence that has blocked ingress and egress to the Musgrove property for decades.” The letter continues with informa tion from the recent survey which also used an historic artesian well at the northern boundary of Village Bluff reserve land as its natural monu- mentation. The survey indicates that “the Lane and Village Drive actu ally appear to be improperly located - with the existing Lane almost en tirely on the land of a German Village homeowner.” The referenced Lane is a dirt ex tension of the end of the paved por tion of Village Drive that the SSLT plans to use to get to the waterfront park and boat dock. The SSLT permit application, detailed in last week’s Islander, shows public access to the park through Village Drive and the easement. The letter continues, “Deeds in the chain of title indicate that former own ers of Musgrove may have possessed a limited easement allowing use of the Lane beyond the pavement as a back entrance to their property - so that their servants and employees could enter their property through a gated and otherwise locked entrance that has stood as a barrier for decades.” Attorney White asserts, “This does not indicate acceptance of this por tion of an easement or right-of-way by the County. The Lane has never been maintained or used by the County and in fact, the County will not pick up garbage from receptacles that are not brought out to the end of pavement at the intersection of Village and Virgin ia Drives.” White states, “It is my understand ing that an infrastructure only per mit was approved for Quale Preserve (SSLT - presumably sites 1 and 2) on December 27, 2018 and that an infra structure only permit is appropriate where there is “a substantial amount of infrastructure work that must be completed prior to beginning of any building construction.” The letter to the County attorney and planning Director explains, “I un derstand that there has been heated controversy concerning the SSLT’s ultimate plans for its Site 2 area and that they have actually repre sented that there would be little im pact to the adjoining neighborhood if SSLT’s plans, as set forth in its grant application^) and other documents, come to full fruition. “There is a great deal of skepticism and concern from members of the ad joining neighborhood and SSLT has offered no support for this claim - no traffic study, no mechanisms for con trol of access to the park, no plan for security for the area or the immedi ately adjacent homes, and no means of addressing the Native American middens that have been identified on the property.” The construction site plan submit ted with the SSLT permit application (CP 3880) only shows a portion of the 258-acre site and indicates that only five parking spaces and a walking trail with gazebo will be located on the waterfront portion of the park. The plans did not show other amenities that have been previously announced by the Land Trust including a public boat ramp and new fishing dock. However, a February 2017 SSLT press release states, “Although the Land Trust is bound by contract not to open the park until all three parcels have been acquired, planning work has begun on improvements such as nature trails, a fishing platform, and a launch for small boats.” The SSLT website includes Turn to Page 9 German Village
