Page 8, March 18, 2019, The Islander Appeals Board Continued from Page 4 legal fees wouldn’t happen if an agreement between everyone would take place,” she said. “Whether you approve this vari ance or not he can still build and develop. If the road issue had been settled prior to this variance applica tion request, he (Duncan) probably would have had support from those landowners,” she said. Islands Planning Commission (IPC) member Carla Cate said the application is incomplete. “No neighboring property owners are listed. I am surprised no county attorney is here. We (the IPC) are told we don’t consider things that are under litigation. I don’t know why this request is at the ZBA. The IPC has denied this same thing for only one lot in the past. Mr. Dun can has denied this type of request, and now he is asking for preferential treatment for nine lots.” Duncan spoke again and said he was amazed at the string of folks that have introduced the road issue which, he said, doesn’t belong in this issue. “It is all legal posturing,” he said. “The road has nothing to do with what I’m asking to do. All I am ask ing is not to be restricted on house style. I wouldn’t have changed the zoning if I had known county was going to implement the substandard ordinance.” “What I supported the IPC turn ing down was proliferating more lots on East Beach. Not what we are talking about here. The restrictions were not there when I purchased the property nor when I agreed to reduce density of property,” he said. “I’m happy for people to use my road. I put warning signs up to keep curiosity seekers out during develop ment. My insurance requires this. I hope we can resolve the road issue. The attorney’s are dealing with it not me,” he said. The the three ZBA members tried to discuss the situation in private but were told that since a quorum was there it all had to be on record. Even though they were told that, it was still hard to hear their discussion. ZBA member Eugene Williams said, “If we approve the application, we’ll be right in middle. I agree the application is not complete and we should deny or postpone.” Fisher said he would deny and Williams agreed. Fisher moved to deny the application with a second from Williams. The vote was Wil liams and Fisher in favor of denial and Viviani against denial. ZBA members Chairman Walter Rafolski and Betty Keller were not at the meeting.
