He also said he did not have a sense of the definition of a coffee shop and said the IPC was concerned with property uses. Ragsdale asked that the GCAC re quest be deferred back to the IPC so they could consider Versions 3 and 4. Julian Smith opposed the request saying in part that there was plenty of private commercial property on the island and he government did not need to go into competition. After a bit more discussion, O’Quinn made a motion to approve Version 4 and eliminate the condition that a change of use would require a new site plan. It passed unanimously. O’Quinn said he was surprised there was not a DNR representative at the meeting. “Has the SSLT ever asked the DNR to amend the conservation agreement to find an alternate route to the water front?” O’Quinn asked. “There have been discussions, yes,” Johnson answered. Murphy said, “Our decision tonight should focus on whether the ZBA has the authority to decide who can and cannot use our county roadways.” “If we find in favor of a decision made arbitrarily by non-elected officials, we will have set a terrible precedent.” Murphy made the motion to affirm the decision by Community Develop ment and to reverse and strike the ZBA decision. The motion was seconded by Com. Bill Brunson who then asked “What would you do if the road were July 22, 2019, The Islander, Page 11 privatized? What if the POA came to the county and asked us to abandon the road? What happens then? I’m asking Mr. Slade or Ms. Shipman ei ther one.” Brunson said the question was hy pothetical so the SSLT attorney, John son, said, “It would be a conversation that would involve numerous other people, not just German Village.” Coleman asked the BOC if they were prepared to vote against their own or dinances discussing adverse effects on single family residential properties. The vote was Chairman Mike Browning, Commissioners Brunson, Murphy, Booker, and Wayne Neal in favor of the motion. Commissioners Coleman and O’Quinn voted no. Com. Murphy’s wife sits on the SSLT Board of Directors and he did not recuse himself from the vote. Regarding the ZBA’s decision Com. Browning was quoted in the Bruns wick News saying “In my opinion, it was a ruling that likely shouldn’t have happened. The Zoning Board of Appeals has no jurisdiction on public roads.” Browning did not recuse him self from the vote.
