It is owned by the Gentile Family Trust and zoned Planned Develop ment - General (PD-G). According to Judge Kelley’s Or der the PD-G zoning text was ad opted by the County in 2005 and amended in 2008 and 2009. The zoning text applies to ap proximately 14 acres of property and provides for a portion of the property to be developed residen tial, and a portion to be developed commercial. Residential develop ment of the property was at issue in this case. Glynn County Community Devel opment Department Director Pa mela Thompson approved a prelimi nary subdivision plat for 50 Oaks which is a townhouse community that would be built behind Bennie’s Red Barn on Frederica Rd. The lawsuit was brought chal lenging the approval of the 50 Oaks subdivision plat. The petitioners claim that vari ous alleged deficiencies with the preliminary plat and the underly ing zoning classification of all or some of the property require that Thompson’s decision to approve the preliminary plat be reversed or de clared invalid. St. Simons Island attorney Jason Tate, represented the Gentile Fam ily Trust. Brunswick attorney Brad Wat kins, represented the county. Attorneys Geremy Gregory and Chris Anulewicz, both with Atlan ta’s Batch and Bingham law firm, represented the plaintiffs. One of the issues concerned 1.11 acres that plaintiffs maintained was not owned by the Family Trust in 2005 when it was rezoned by Glynn County from R-6 to Planned Devel opment. The rezoning was amended in 2008 and 2009. According to the Order, there is evidence attached to the pleadings which shows that the property as a whole, including the 1.11-acre par cel, was rezoned PD-G. In fact, the minutes and the resolution for the 2005 rezoning refer to the rezoning of the entire 14.6-acre tract of prop erty arriving at 14.6 acres in this calculation necessarily includes the 1.11-acre parcel. The plaintiffs acknowledge that the Gentiles owned the property surrounding the 1.11-acre road par cel in 2005. The Order also points out that the rezoning was not appealed on a timely basis. Judge Kelley granted Defen dants’ motions to dismiss the law suit and dismissed the action with prejudice.
