Sympathy is expressed to Steve and Linda Smith in the sud den loss of Brian, their 45 year old son, grandson of Norma Mock. Sympathy is also extended to the family of Paul and Cathy Hegeman in the sudden death of his 45 year old brother Mark Hegeman. Rev. Dr. John Stephens, Senior Pastor at Chapelwood UMC in Houston, Texas, will be guest preach er in all three services on Sunday, Au gust 25. Dr. Stephens is former Pastor of Wesley United Methodist Church on St Simons. St. Simons Presbyterian Church extends sympathy to Char lotte Lueckel and family in the death of her husband Bill Lueckel, to the family and friends of Mary Kather ine Arenas, mother of Greer Ander son, and to the family and friends of Bill Kyekel. Congratulations to Carla Cate who was named Teacher of the Year at Greer Elementary School. St. William Catholic Church extends sympathy to Ray Arens and family in the death of his wife Mary Katherine Arens. Flowers were placed in Brunswick First United Methodist Church in loving memory of Ellen Voigt - wife, mother, nana, aunt and friend. Brunswick Christian Renewal Church extends sympathy to Elder Henry Wright and family on the pass ing of his brother in law Joe Bradley. Kellen Lariscy is the new Interim Head of Heritage Christian Academy. Dorothy “Dottie Anne” Smith, a member of Christ Church, Fred erica, entered into rest on August 13, 2024. The funeral was held at Christ Church, Frederica on Saturday, Au gust 17 followed by a reception in the Parish Hall. Homecoming is sched uled Sept. 6 through 8. I join with family and friends in ex tending sympathy to Terri Hardman in the death of her father Neal Elder. Our Gibson Family birthdays con tinue in August with Number One Grand Emily, Number One Son Billy Jr, and Number One Son In Law/Love David. Seems like the road to Atlanta gets longer with each passing year. Only Billy Jr. is close enough for a birthday hug. According to Glynn County officials, the county has received payment from Jeff Kilgore following more court fil ings and an order from Judge Roger Lane in the Frederica Rd. realignment case. Background Jeff Kilgore and the Center for a Sustainable Coast (CSC) sued Glynn County and Christ Church over the Frederica Road Realignment project. After the County won the case, Judge Roger Lane awarded $96,835.61 in total attorneys’ fees and expenses to Glynn County and Christ Church. In July 2024, the Court granted the County’s motion to compel Jeff Kilgore to respond to post-judgment discov ery requests, imposing an additional $2,278.50 in attorney’s fees on Kilgore for non-compliance. Judge Lane’s order stated that Kilgore and the Center for Sustainable Coast’s lawsuit lacked merit and was brought without justifiable legal or factual basis. The claims were deemed to be with out substantial justification and were seen as delaying tactics or harass ment, unnecessarily prolonging the legal process. 2020 In 2020, the County entered into an agreement with Christ Church which required the Church to pay for the en tire cost of construction for the Fred erica Road Realignment project, except for a small amount of costs contributed by the County for improvements to an adjacent Stevens Road portion of the project. That agreement also involved the exchange of property of equal value with the Church needed for the relo cation. In return the County received property for the new portion of the Frederica Road, and the Church re ceived the old portion of Frederica Road, as well as Old Monument Road. September -October 2021 In September 2021 Kilgore and CSC filed a lawsuit against the County and Christ Church challenging the Fred erica Road Realignment project based on allegations pertaining to alleged violation of the tree ordinance. The plaintiffs (Kilgore & CCS) law suit was amended shortly after that to add allegations challenging the prop erty exchange. In October 2021, Judge Lane held a hearing on these issues, and denied the Plaintiffs request for a temporary restraining order. Road work was al lowed to recommence. November-December 2021 After Judge Lane denied the Plain tiffs request for a temporary restrain ing order on October 26, the plaintiffs amended their lawsuit for a second time; this time adding a new allegation that the Frederica Road Realignment project constituted impermissible fi nancial aid to a religious institution and violated the establishment clause of the U.S. and Georgia constitutions. The Court held a hearing in Decem ber 2021 on whether to issue a tempo rary restraining order and interlocu tory injunction against the County and Church based on these new claims. Judge Lane again issued an order shortly after the hearing concluded ruling in the County and Church’s favor and denying the Plaintiffs Mo tion for Temporary Restraining Order. Road work was allowed to continue to proceed. April 2022 By mid-April 2022, the newly re aligned portion of Frederica Road was completed and open for public use. October 2022 - January 2023 In October 2022, the plaintiffs vol untarily dismissed the case against the County and Christ Church. The County and Christ Church then sought attorneys’ fees and expenses from the plaintiffs. In January 2023, Judge Lane issued an Order awarding attorneys’ fees and expenses to both Glynn County and Christ Church. Judge Lane awarded $40,143.32 in attorneys’ fees and expenses to Glynn County, and $56,692.30 in attorneys’ fees and expenses to Christ Church, for a collective total award of $96,835.61. March 2023 The plaintiffs then tried to appeal Judge Lane’s order awarding attor neys’ fees and expenses to the Georgia Court of Appeals. In March 2023, the Georgia Court of Appeals Order issued an order deny ing the plaintiffs application seeking to appeal Judge Lane’s order awarding attorneys’ fees and expenses. In short, the Court of Appeals de clined to take up or review the appeal. February 2024 After the Court of Appeals declined to take up or review the appeals, the plaintiffs then tried to appeal the Judge Lane’s order awarding attor neys’ fees and expenses to the Georgia Supreme Court. In February 2024, the Georgia Su preme Court issued an Order denying the plaintiffs application seeking to appeal Judge Lane’s order awarding attorneys’ fees and expenses. Like the Court of Appeals, the Su preme Court declined to take up or re view their appeal. The County and Christ Church proceeded with efforts to collect the amounts owed. The numbers referenced above only include the amount of attorneys’ fees and expenses owed awarded prior to the appeals and do not include the fees and expenses incurred defending the appeals.
