NOTICE OF SALE UNDER POWER
IN DEED TO SECURE DEBT
Under and by virtue of the power of
sale contained in that certain Deed to
Secure Debt from Jerry N. Hudson and
Betty L. Hudson to Fleet Finance, Inc.,
ARI Corp. dated November 8,1990, and
recorded in Deed Book 898, page 562,
Houston County records, the under
signed will sell at public outcry to the
highest bidder for cash before the
Courthouse door in said County, during
the legal hours of sale, on the first
Tuesday in June 1996, by Fleet Finance,
Inc. ARI Corp., as Attorney-in-Fact for
Jerry N. Hudson and Betty L. Hudson the
following described properly:
All that tract or parcel of land situate,
lying and being in Land Lot 113 of the
Fifth Land District of Houston County,
Georgia, being known and designated as
Lot 13, Hattie Subdivision, No. 5, accord
ing to a plat of survey prepared by
Waddle Surveying Co., dated July 15,
1957, and recorded in Map Book 4 Page
265, Clerks' Office, Houston Superior
Court. Said plat and the recorded copy
thereof are hereby made a part of this
description by reference thereto for all
purposes.
This conveyance is subject to an open
deed to secure debt in favor of Stockton,
Whatley, Davin & Company per Deed
Book 625, Page 541, Clerk's Office,
Houston Superior Court, which grantee
herein expressly agrees to assume.
The indebtedness secured by said
Deed to Secure Debt having been
declared due and payable because of
default in the payment of the indebted-

ness secured thereby, this sale will be
made for the purposes of paying the
same and all expenses of sale, including
attorney’s fees, (notice having been
given as provided by law). The property
will be sold as the property of The
Aforesaid Grantors subject to the follow
ing:
(1) all prior restrictive covenants,
easements, rights-of-way or encum
brances; (2) all valid zoning ordinances
(3) matters which would be disclosed by
an accurate survey of the property; and
the outstanding ad valorem taxes and
assessments, if any, and unpaid water
and sewage bills, that constitute liens
against the property, whether due and
payable or not yet due and payable. To
the best of the undersigned’s knowledge
and belief, the parties in possession are
Jerry N. Hudson and Betty L. Hudson.

Because of default in the payment of
the indebtedness secured by Deed to
Secure Debt executed by Jimmy Dean
Estes and Sandra Alma Estes to Destiny
Factory Outlet, Inc., d/b/a Tradin Tim's
homes dated October 1, 1993, filed at
Deed Book 1050, Page 599, and
assigned to Green Tree Financial Corp.
at Deed Book 1050, Page 607, Deed
Records, Houston County, Georgia, the
undersigned, Green Tree Financial
Corp., pursuant to said deed and the note
thereby secured, has declared the entire
amount of indebtedness due and
payable, and pursuant to the power of
sale contained in said deed, will on the
first Tuesday in June, 1996, during the
legal hours of sale, at the courthouse
door, Perry , Houston County, Georgia, to
sell at public outcry to the highest bidder
for cash, the property described in sad
deed, to-wit:
All that tract or parcel of land situate,
lying and being in Land Lot 119 of the sth
Land District of Houston County, Georgia,
and being known and distinguished as
Lot No 12 of Block "A" of Robins Resort
West Subdivision, more particularly
described according to a plat of record in
Plat Book 29, Page 63, Houston County
Deed Records, which said plat is by this
reference thereto incorporated herein for
the purpose of a more particular and
accurate description of said Lot No. 12
hereby conveyed. This is the property
known as 102 Roxana Court, Warner
Robins, Georgia.
Also conveyed with said land is a cer
tain 1993 Destiny Omni Manufactured
Home, Manuf. ID# 035982A8 which is
affixed to the described real estate and
made a part thereof.
Said property will be sold subject to
the following encumbrances:
I. Outstanding ad valorem taxes and
assessments, if any. Notice will be given
of intention to collect attorney's fees in
accordance with the terms of the note
secured by said deed.
Said property will be sold as the prop
erty of Jimmy Dean Estes and Sandra
Alma Estes and the proceeds of said sale
will be applied to the payment of said
indebtedness, accrued interest, expens
es of the sale and other sums secured by
said deed including attorney’s fees, with
the remainder, if any, being applied as
provided by law.
To the best of the undersigned's
knowledge and belief, the property is in
the possession of Jimmy Dean Estes and
Sandra Alma Estes.

Association of Wamei Robins, dated July
25, 1996, recorded in Deed Book 72,
Page 611, Houston County, Georgia
Records, as last transferred to State
Street Bank Trust Company, as Trustee
by assignment to be recorded in the
Office of the Clerk of the Superior Court
of Houston County, Georgia, conveying
the after-described property to secure a
Note in the original principal amount of
TWENTY NINE THOUSAND SEVEN
HUNDRED & NO/100 DOLLARS
($29,700.00), with interest thereon as set
forth therein, there will be sold at public

being known and designated as Unit 1,
Building No. 2, Harbour Towne
Condominiums, together with its appur
tenant percentage of undivided interest in
the common elements, as described in
that certain Declaration for Harbour
Towne Condominiums, of record in Deed
Book 712, Pages 482-517, as the same
may be amended from time to time, and
on As Built Plan prepared by Waddle &
Company, dated June 26,1986, together
with the Condominium Plans, which are
on file with the Office of the Clerk of the
Superior Court of Houston County,
Georgia. Said Declaration, As Built Site
plan and Condominium Plans, as amend
ed from time to time, are incorporates
herein by reference thereto for all pur
poses. This conveyance is subject to all
of the provisions of Said Declaration and
the Georgia Condominium Act (O.C.G.A.
Title 44-3-70), as amended from time to
time, which provisions the Grantee here
in assumes and agrees to observe and

The debt secured by said Security
Deed has been and is hereby declared
