Under and by virtue of the Power of
Sale contained in a Security Deed
given by Tim R. O’Neal to U.S. Money
Source, Inc., dated March 29, 1996,
recorded in Deed Book 1205, Page
461, Houston County, Georgia
Records, as last transferred to Mellon
Mortgage Company by assignment to
be recorded in the Office of the Clerk
of the Superior Court of Houston
County, Georgia, conveying the after
described property to secure a Note in
the original principal amount of Seven
ty Thousand Three Hundred & No/100
Dollars ($70,300.00), with interest
thereon as set forth therein, there will
be sold at public outcry to the highest
bidder for cash before the courthouse
door of Houston County,' Georgia,
within the legal hours of sale on the
first Tuesday in July, 1999, the follow
ing described property:
All that tract or parcel of land lying
and being in Land Lot 163 of the Fifth
Land District Of Houston County,
Georgia, being known and designated
as Lot 7, Block G, Section No. 2,
Phase No. 2, Canterbury Estates Sub
division, according to a plat of survey
of record in Plat Book 14, Page 130,
Clerk's Office, Houston Superior
Court. Said plat and the record there
of are incorporated herein by refer
ence for all purposes.
The debt secured by said Security
Deed has been and is hereby
declared due because of, among
other possible events of default, failure
to payjhe indebtedness as and when
due and in the manner provided in the
Note and Security Deed. The debt
remaining in default, this sale will be
made for the purpose of paying the
same and all expenses of this sale, as
provided in the Security Deed and by
law, including attorney’s fees (notice of
intent to collect attorney's fees having
been given).
Said property will be sold subject
to any outstanding ad valorem taxes
(including taxes which are a lien, but
not yet due and payable), any matters
which might be disclosed by an accu
rate survey and inspection of the prop
erty, any assessments, liens, encum
brances, zoning ordinances, restric
tions, covenants, and matters of
record superior to the Security Deed
first set out above.
