beside lands, lots, negroes & c . in the
territory of Florida, and particularly
one large tract of land bought of Forbes
& Co. laying between the rivers St
Marks and Apalachicola in the territnrv
of Florida aforesaid.
These arc hereby to caution the
public against purchasing any part of
tlie said property or estate so convey
ed, or any other property belonging to
the said Carnochan & Mitchell or either
of them, as I hold prior mortgages on the
greatest part thereof, which are on re
cord in the registry in Savannah and
Darien aforesaid, and in Charleston S
C. and equitable liens on all the
perty of said John Carnochan and Pet-
Mitchell.

J CARNOCHAN and P. Mitchel,
• are sorry to be again brought
before the public by a second notice of
Mr. Christie’s, who has undoubtedly
c|aims against them which when finally
liquidated on the decision of the suit
now pending, they will try to satisfy as
soon as possible thereafter.
The deeds ui*der which Mr. Christie
claims an exclusive right to all the
real and persemd estate of Carnochan
and Mitchel, are considered as infor
mal, unjust ahid illegal. Hence they
have been brought and are still before
the Court, aud other deeds have been
executed and recorded, conveying the
property for the use of all their credit,
ors, Mr. Christie included ; without
any trust or reservation beneficial to C.
ajid M. or their families ; and if this
be not to that gentleman, it
must nevertheless appear fair and equi
table to the public and all who have a
sense of justice.
The Trustees under the lr.te deeds
are anxious to sell the Lands in Florida,
ailuded to in the notice of Mr C and
lo apply the proceeds to the immediate
payment of part of his demand and de
post a sufficiency thereof to coverall
his claim, subject to the decision of the
Court—but ids opposition to any rea
sonable sale, as one interested io hii
own right, whilst injuring all parties
concerned, must be borne until a sale
can be made under an order ot Court.
