ledge late Governor of this Stare,
Inch this day accepted the appointment of
Senator from this State in the Congrtfs of the
U. States, agreeably to his clecU jn thereto,
on the 19th day of June Jaft, by the Legis
lature, and hath ftghified to me his resigna
tion of the G tvern nent. —And whereas,
the fourth lection of the feconi article of the
(j >nuittuion, declares, that “ in case of the
death or resignation, or disability of the

The distance isdlimated at 154 miles-—All
this distance, or the principal part ot it, the
foad has been cut out, by the military and
prepnhd conveniently for use, fume few

ford. Distance estimated at 40 miles. 'I his

The road is to be made and completed by

and the work is, in all refpeirs; to be done
to the approbation ofßeturn Jonathan Meigs,
efq. or Thomas \Vright efq. agent fur the
United States, refrding in the Indian coun
tries. In disking the fame, the following
rules are ftricfly to be observed.
I ft. The road must be made at lead twen
ty feet wide, ?,rd all the timber and under
brush taken oil'for that did mice.
2nd. All n.arlhy places arc to be caofway
td, and all causeways ase to oe at lead
ten feet wide. . . •

AN ACT
Relating to bonds given by marjhalt,
BE it ensiled by the Senate and Hatt/t of
Refre/entatives of the United States of
America, in Cong refs Afftmbled, That the
bond heretofore given, or which may here
after be given by the marlhal of any di ft rift,
lor the faithful performance of the duties of
his office, fliall be filed and recorded in the
office of the cleric ofthediftrift court or cir
cuit coui t, fitting within the dtftrift for
which such marlhal Qull have been appoin,
ted, and copies thereof certified by the clerk;
under the fed of the said court, lhall he com!
petent evidence In any court of joflice.
Sec. a. And be it farther t nailed, That
it (ball be lawful in case of the breach of tho
condition of any such bond, for any perfonj
persons, or body politic, thereby injured;
to inftitutca fait upon fudi bond in the name
and for the folc ufc of such party, anti
thereupon to recover such damages as fliali
be legally aflVfltd, with colls of fuitj for
which execution may iffuc for such party in
due form, and in case such party lhall fail
to recover in the suit, judgment lhall be
rendered, and execution may issue for coda
in favor of the defendant ordefendancs againlf
the party who (ball have inllituted the suit
and the United States lhall in no case be
liable for the fame.
Sec. 3. And be it further mailed. That
the said bonds (ball, after any judgment, of
judgments, rendered thereon, remain as a
fecutity, for the benefit, of any person;
persons, or body politic, injured by breach
of the condition of the fame, until the whole
penalty (lull have been recovered, and the
proceedings lhall be always in the fame man
ner, and as hereinbefore directed.
Sec. 4. And be it further enaded, That
all suits on marlbal's bonds, if the right of
afticn has already accrued, (hall be conu
mcnced and prosecuted within three years
alter the paflage of this aft, and not after
wards. And all such suits, in case the right
of aftiort (hail accrue hereafter, (hall be com
merced and prosecuted within fix yeats after
the said right of aft ion (hall have accrued;
and not afterwards; saving, ncvcrthelcfs,
the rights of infants, feme coverts, and
persons non corrtfas mentis, so that they Cac
within three years after their difabilitiei
