was a negro of the deepest dye. He was
no doubt named in honor of “Old Hick
ory," and when a man told him that he
could not haul off the aand which be
longed on his lot, Steve said, “By tbe

proposed to kill the man with some rocks.
For wanting to take the law in his own
bands, lie was required to pay a tax li
cense of 825 and coats. This made Ste
ven very siok.

Thu testimony in tho ease of W. D. R.
Millar was again resumed yesterday morn
ing by the defense introducing
MR. W. U. CLARKE,
who trxtiflod that ho hail purchased war
rants for claims on the State on aovoral
occasions; that there were a number of
them on tho market in January and Feb
ruary; that Mr. James, perhaps, also
dealt in them; and that ho (Mr. Clarke)
had discounted them at 5 per cent

Local Agent of the Macon and West
ern Railroad, resumed his place on
tho stand, and testifiedI have
made close and diligent search in the
books of the Affvocy from tho 1st Sep
tember, 1870, to 1st January, 187L
found reoord of SO barrels of keroaene
oil, shipped from Now York, on the 18th
of December; 60 barrels of oil on the
1-ttb, and 6 barrels on the 15th. I do
not kuow the consigner. I found no
record of any wheelbarrows, nor picks,
nor ropes, nor of anything corresponding
to the articles enumerated in Mr. Millar’s
claim, except that on the 80th of De
cember, I found record of 3 boles of
waste, end on the 31st Pecember an in
voioa of some shovels. As to the other
articles, I am sure that nono of them have
ever poised over our road.
Cross Examination.—Nearly all there
entries were made by one olerk, Mr. P,
C. Dodge, now of Cliattouooga. All the
freight received is distributed and re
corded by one clerk on the day of its ar
rival. The original bills are on file in my
office. Tho dark could not fail to enter
any articles that may havo arrived, nor
was it possible for him to steal anything
without 1 wing detected. The hills and
invoices sent in the conductor's car With
every train would have convicted him.—

are several were probably, aa is often the
caw, the consequence of absence of Blind

that Road, in care from our depot to that
of the State Road. (Hero followed some
unimportant testimony concerning the
dnties of the recording clerks and ware
house clerks.) Cross examination was
suspended. Gen. Gartrell then stated
that he desired that tho hooka should be
examined from 1st February to May, to
see whether there was any record of tho
shipment of the steam pump. Ho said
there was indisputable evidence that it
was received, and if there was no record
of its shipment, this fact would be evl
deuce that shipments were sometimes
made of which there was no record. The
books were then examined, and the cross
examination being resumed, witness tes
tified that tho pump was received on the
8th of May, having been shipped ou the
Gth. Hero both the Prosecution and
Dcfuose announced tlint their testimony
hail closed, when
GEN. OARTRELL
arose and said: I am instructed by my
client, your Honor, to say that he desires
to afford every facility for instituting tho
most thorough scrutiny into the circum
stances of the transaction, in which he is
charged with fraudulently obtaining tho
State funds. Some of the goods—all of
the goods indeed—have been re
counted for; and we have proved by com
petent witncaaee, whose honor is unim
peachable, that they were received. If
any doubt or suspicion should yet encum
ber your Honor's mind, we propose to
continue this ease until my client can
produce more satisfactory evidence; until
he con visit hia home, and there obtain
hia clerk, with hia voachers, oontainiag
records of the shipment of there goods
from Suvaunah. It is the desire of him
self and his father to clear up everything.
Therefore, if it is agreeable to your Hon
or, we respectfully ask that shfficient time
bo allowed the prisoner to return homo
and collect this evidence, when the the
investigation can be resumed.
CoL Bleckley here interposed, and said
that the prosecution foreseeing the value
of the evidence, had already served a
aUBRCENA
on Mr. Millar's clerk, accompanied with
instructions to bring all the books and
accounts that were calculated to afford
any evidence on this ease, and that he
was expected to-day.
Gen. Gartrell stated ou tho authority
of tho prisoner that it was impossible for
the clerk to gain access to the liooks, as
they were in Mr. Millar’s safe and the
key was in liis possession, and urged the
propriety of appointing a day of next
week for resuming the investigation.
Judge Hopkins stated that it was
impossible to appoint a day for hear
ing tho testimony before Friday, 15th
September, which day was agreed upon.
The securities then came forward and
acknowledged their boDds, and after an
agreement between tho counsel on both
sides to deposit the written evidence in
Gen. Gortrcll's office, tho Court ad
joumed-

Alexander charged with the killing of a
negro man, Hamp. Whitehead by name,
which excited a large amount ot public
interest—tho result of which was tbut

bail.
A writ of luibtus corjtus wan sued out
and heard before Judge Hopkins of the
Supreme Court, who remanded the
prisoner to jail, refuting bail.
Yesterday a writ of habem corpus wan
sued out before Judge Pittman, the Ordi
nary, who, after a patient hearing, grunt
od the application and admitted thepriH
oner to bail in the Hum of $20,000, which
was promptly given, and Alexander Bet
set at liberty.
Tho case was immediately carried be
fore Judge Hopkins by certiorari, pray
ing a 8ujtersedea8 of Judge Pittman’s de
cision in the oai^e, so that tho prisoner
might be remanded to jail and not allow
ed to give bond and be set nt liberty.
This tbe Judge refused to grant upon the
ground that no supersedeas from him
would be lawful or in order at this time ;
and the certiorari stands to be heard on
its merits at the next term of the Supc
rior Court, and the prisoner reinuius un
der bond in tbe sum of $20,000.

It is well known that I am a sworn
olfioer and special Polioeman at the
depot; and tho manner in which I have
been attacked ia ao insidious that it leads
the publie to bolive that j[ am nsglooting
my duty, without giving me .the oppor
tunity of calling portiea who thus malign
mo to account.

i A. IUl, I went, in the meantime to
tbe depot, at tbe arrival "and departure
Yesterday some little white girls were
playing in the bushes, near the Bolling
Mills, when a negro boy suddenly ap
peared on the scene, and seizing the Iar
gest one, a girl about thirteen years, at
tempted to commit an outrage upon her
person. Tbe sereams of the other chil
dren so frightened him that he ran away
without accomplishing his purpose.
Soon after Mr. Will Cook and Joliu
Parish were driving by in a buggy and
heard of the affair and got a description
of the negro. They had not gone far
licfore they came up with a boy filling
the description they hml received and
took him in charge. Ho was made to
get in the buggy and driven back to the
house, to sco if lie would be identified ns
tho ruffian. As soon as tho exasperated
father of tlie child saw him he rushed
out with his pistol to kill him, and Cook
drove off a few steps, while Parish at
tempted to reason with him. While this
was going on tho negro became so fright
ened that he jumped from the buggy and
fled. In doing so he nearly dragged Mr.
Cook from the buggy, who, holding his
horse with one hand, had only tlie other
one to detain the scoundrel.
The police were immediately set upon
his track and doubtless he will be cap
tured.
