WASHINGTON.
A WAR DF.CTNION OF T1IE HU-
PREME COURT.
Washington, November 24.—In the
oaso of tho United States against Lapino
and others, tho Supreme Court to-day de
cided that when a party advanced funds
to n film in New Orleans to be need by
their agents in tho interior for tho pur
chase of cotton prior to the capture of the
city in 1802, all the parties being then in
Now Orleans, and tho city was captured
by tho Federal forces before the cotton
was purchased with the funds so
advanced. The agent having gone
into tho interior prior to the
oapturo, his ageuoy to purchase cot
ton was terminated by the hostile position
of his principals towards the cotton own
er, consequent upon the capture, and
that a purchase of cotton afterwards was
an effectual aid to tho enemy, it was for
bidden by the soundest principles of pub
lic law. Tho purchaser, therefore, ob
tained no title to the cotton, and had no
claim against the Government for its cap
ture.
Mr. Justice Hunt delivered the opinion.
Justices Miller and Field disseuting.
