the Georgia Medicine Company until the
further order of the court wni secured
from Judge Pendleton Wednesday morn
ing by the last named company.
The Georgia Medicine Company, which Is
composed of Alfred and W. W. Austell and
A. B. Jones, alleges that In May, 1W8,
the llerrfng Medicine Company * was or
ganized for the purpose of manufacturing
Herring's Catarrh Cure, In which II. I,.
Herring was Interested.
Rome time later, they affirm, Mr. Her
ring suggested that they organise Hiiothcr
company to he known as the Georgia Med
lelne Company, for the purpose of manu
facturing i'apltolenm. a preparation for
the hair, the formula for which wan pre
pared by Mr. Herring. To this proposition

caused the Cannon mills, of Concord,
to make an offer lo the farmers of the
section to advance them s cento on all
cotton turned over to the mills, agree
ing to hold the same until such time as
the farmer decides to sell at the then
prevailing price.

At 8 o'clock Tuesday night Samuel
Deter Nile*, aged 77, one of the best
known and a pioneer citizen of At
lanta, passed away at hi* residence,
28 Spruce street, after a short illness
of pneumonia. Mr. Niles was a native
of Auburn, N. H.. and when a very
young man came to Atlanta. He wan a
resident of this city when It was cap
tured and burned by Sherman’s army.
Mr. Nile* was an educator and for
Home time conducted a largo school
here, but retired from active business
some time ago. He was the oldest
member of the First Baptist church.
Mr. Nile* for many years was a
member of the Arm of Longley &
Nile*, which did an extensive lumber
and building business. He owned the
property upon which the Atlanta, Bir
mingham and Atlantic railway termi
nal* are now being erected, and until
hi* retirement several years ago was
one of the most prominent business
men of the city as well as one of its
most loved and respected citizens.
Mr. Niles was twice married. Mrs.
George J. Carr, the only child of his
first marriage. I* now a resident of
New York, and it wa* while visiting
I her that Colonel Niles contracted the
disease which resulted In his death.

Ragan, former postmaster of Anniston,
and Frank Robert*, former registry
clerk in the Anniston postofflce, before
Judge Oscar R. Hundley in the United
Htate* district court yesterday after
noon entered pleas of guilty and were
sentenced a* follows:
Ragan, five yearn In the Atlanta pen
itentiary and to pay a fine of $43,000;
Roberts, eighteen months In the At
lanta penitentiary and to pay a fine of
$4,328. The amount of Ragan's em
bezzlement wa* $3,022.81. Roberts' em
bezzlement was $184. Judge Hundley
stated In Ragan's on*? that *incc he
has been judge he ha* never given the
extreme penalty, but that he would
have to do so In this case.
