fen*#*. Alex Walker, the first fried of tha
iipgroea who were in the mob which killed
«'aunty Policeman Heard in South Atlanta
September 24, was found guilty or murder
by n superior court Jury late Wednesday af
ternoon after comparatively short delibera
tion. The Jury recommended mercy, and
Judge Uonn, acting on this. Immediately
sentenced the negro to life Imprisonment
and certified to a motion for a new trial* to
be heard In about two weeks.
The entire five hours allowed by the court
for argument were consumed and It was
nearly 5 o'clock when Judge Kuan begnu
Ills charge. J. 1). Kilpatrick, who spoke
for the defense, claimed that the negroes
who shot Heard were afraid-whether or
not their fear was Justified—that they were
■cared of a mob which. It had been report*
ed. wns coming to Brownsville, and that
when they saw the squad of'men coming on
foot they did not realise that they were
•ounty (K)llce.
The cases will be-earrled first to the state
supreme court and if the -decision of the
lower court Is not reversed or modified

All of the witnesses In the cases con
nected with the killing of Mr. Heard
have been excused until they get fur
ther notification from the court. The
evidence In the cases'of some 13 or 20
of the other prisoners is Identical with
that Introduced In the Walker case
and the defense will be ah
lines. For this reason the
remaining case* will be put off until
utter the argument for a new trial in
i he Walker case.

occurred here this morning on the-Central
railroad bridge over the Ocmulgeo river, be
tween freight trains No. 95 and No. 37,
from Savannah.
Train No. 95 was hi charge of Kuglucer
Wagner. Conductor Jones had arrived In
the yard and was standing ou the bridge.
Train So. 37 was In charge of Kugiuetv
Carr and ( onduetor Truesdale.
