Hugh B. Lincoln, of 40 Park avenue,
for the past four years connected with
the firm of John Sllvey/A Co., escaped
Wednesday afternoon about 4 o'clock
from the Presbyterian hospital while
In a delirium, and, deaptte an energetic
search by frlanda and the police, no
trace of him haa been found.
Lincoln fled from the hospital In his
shirt eleevee at a favorably opportuni
ty, when no one wee watching him. A
description of the mleelng patient wax
furnished the police and the member,
of the force were directed to keep a
lookout for him.
Lincoln was taken 111 recently and
for the . past three weeks has been an
Inmate of the Presbyterian hospital.
Wednesday he grew worse and his
mind became affected.
Shortly after 4 o'clock hi, nurie dl«-
covered hi, room empty and a search
wa» made for him. Every conceivable
place In the hospital, where a man
might hide, was searched, but the pa
tient could not be found. The escape
w?r then reported to the police and
their aid enlisted In the search.

Three Interesting points concerning
new counties are decided In a decision
handed down by the supreme court on
Wednesday morning In the case
Moore vs. the State from Crisp supe
rior court. <
The three points decided are as fol
lows;
1. A merchant paying for a telephone
Into a dry county, who undergoes the
expense of persona In dry county using
phone for ordering liquors, Is not guil
ty of soliciting bus|nsss-
2. A parson selling whisky In a dry
county cannot be convicted of selling
liquor without a license, aa such coun
ties do not grant license. If guilty In
any particular It le of violation or lo
cal option laws.
3. A new county created out of a dry
county la aleo dry until the Issue Is de
cided by the people In a regular elec
tion.
Representative J. T. Hill represented
Moore In the action In the superior
court. He demurred to Jhe Indictment
for “selling liquor without a license.”
The supreme court reversed Judge Lit
tlejohn In refusing to grant tne de
murrer.
Moore conducts a saloon at DeSoto,
Sumter county. He pays folia on all
orders telephoned him from Cordele,
which Is now In Crisp county. The
court holds that the telephone le an
Inanimate vehicle of transmission for
such orders, and that the owner of the
same cannot be prosecuted for using
it for that purpose.

Mineral railroad, to run from this city
to Lancaster, S. C., to connect with the
