The following cases comprise the
June 10, 2014, Civil JURY calendar
and will be tried during a one-week
period beginning, August 12, 2014
thru August 15, 2014. There will be
NO CALENDAR CALL. All cases
should expect to be reached and
must be ready for trial or subject to
dismissal. ALL CASES WILL RE
MAIN ON 3 (THREE) HOUR CALL.
If you require more than 3 (three)
hours’ notice, please advise the cal
endar coordinator in writing of your
reasons and requirements before Ju
ly 29, 2014. Telephone notice of trial
may be given between July 01, 2014
and July 31, 2014. Cases may be
called out of order as scheduling de
mands. Failure to report when called
shall subject the complaint, answer or
counterclaim to dismissal or subject
counsel or the parties to such other
sanctions as the court may deem ap
propriate, including, but not limited to,
the removal of the case from the trial
calendar.

CEDE ANY PRIOR NOTICE. Parties
remain subject to call for trial pursu
ant to any prior calendar notice.
The removal of any case from the tri
al calendar shall be only by order of
the Court, Continuances will not be
granted except for legal excuse. In
the event you have a legal excuse,
please advise the calendar coordinat
or in writing. If a case is settled or
otherwise resolved in any manner,
the parties must notify the calendar
coordinator immediately and follow
up with a letter confirming dismissal
or settlement.
The parties must submit a consolid
ated pretrial order in conformity with
Uniform State Court Rule 7.2. Each
litigant bears joint and several re
sponsibilities for ensuring that the
consolidated pretrial is filed. Failure
to respond to this notice or to timely
complete the proposed Consolidated
Pretrial Order MAY WELL result in
the dismissal of the complaint, an
swer, or counterclaim as appropriate;
or to subject counsel or parties to
contempt sanctions as the Court may
deem appropriate; or alternatively, if
the Court deems a lesser sanction is
deserved in the removal of the case

Court for the Civil Non-Jury Trial Cal
endar on August 13, 2014, at 9:00
A.M. in Courtroom B on the Second
Floor of the Judicial Tower, located at
556 N. McDonough Street, Decatur,
Georgia 30030. Corporations must
be represented by counsel in all
actions filed on or after June 5,
1997. Eckles v. Atlanta Techno
logy Group, Inc., 267 Ga. 801, 485
S.E.2d 22 (1997). Counsel and
parties should appear with their wit
nesses, ready to proceed to trial at
that time. All conflicts shall be
handled as required by Georgia Uni
form Court Rule 17.1. Attendees at
the Non-Jury Trial Calendar must
have express authority to settle the
pending claim(s) and must be pre
pared to confidentially reveal the
terms of settlement to the Court.
The removal of a case for any reas
on from the Non-Jury Trial Calendar
shall be by Order of the Court only. A
Motion for Continuance must be

deemed to have waived the right to
trial by jury for damages pursuant to
Collins v. Jones, 197 Ga. App. 839,
399 S.E.2d 546 (1990).

Conference Calendar)
Counsel and pro se litigants in all lis
ted cases are directed to appear in
Court for the Division VII Civil Pre-tri
al Conference Calendar on August
13, 2014, at 1:30 p.m. The purpose
of this Conference is to determine the
status of the case, resolve remaining
issues, and schedule the case for tri
al. A Consolidated Pre-Trial Order
will be due sixty (60) days before
trial, but the Order need not be
prepared for the Pre-Trial Confer
ence.
At the Pre-trial Conference, counsel
and parties representing themselves
must be prepared to address any re
maining discovery issues, all pending
or anticipated motions, chances of
settlement, length of trial, number of
jurors, jury pre-qualifications, and
court reporting of the case. Counsel
and parties are expected to confer,
exchange documents and resolve
any discovery disputes. Further, they
