More specifically, on March 19, 2014 Atlanta Police Department executed a search warrant at 1580 Dixie Street, Apt. #10, Atlanta, Georgia 30317. Upon entry into the residence Atlanta Police cleared the residence and found no one to be inside the residence. During search of the resid ence Atlanta Police recovered 550.59 grams of marijuana, $2,342.00 in U.S. Currency, and 8mm starter pis tol, electronics, vacuum sealer, pack aging material, digital scales, 4 pre scription bottles belonging to ++Jer- maine Berry++. Vile containing an unknown substance and security cameras were also found. Atlanta Po lice observed a red Dodge Ram tag# PQN4432 parked directly in front of the apartment door and could smell a strong odor of marijuana emanating from the vehicle. Atlanta Police knew this vehicle was associated with the target location due to the vehicle be ing parked in the exact same spot previously and seeing it entering and leaving the location on several occa sions during surveillance and the tag was registered to Jermaine Berry. The K9 alerted on the vehicle and At lanta Police obtained a search war rant and entered the vehicle and re covered electronics, insurance paper work belonging to Jermaine Berry, marijuana cigarette 1.1 grams, 17 opened vacuum sealed bags with marijuana residue. (These bags matched the vacuum bags located in side the target location with marijuana in them). All illegal narcot ics, money and other recovered items were placed into Atlanta Police Prop erty. All parties were charged accord ingly. Berry was charged with Violation of the Georgia Controlled Substances Act. The marijuana is subject to for feiture pursuant to O.C.G.A. § 16-13- 49(d)(1). The currency is subject to forfeiture pursuant to O.C.G.A. § 16- 1349(d)(2). Barrett of the Dunwoody Police Department: a. Approximately 1.3 ounce of marijuana; and b. Approximately 2 grams of cocaine; and c. 2004 Cadillac CTS, VIN# 1G6DM577540190019. Conduct giving rise to said seizure was as follows: Said property: a. was directly or indirectly used or in tended for use to facilitate a violation of the Georgia Controlled Sub stances Act, O.C.G.A. § 16-13-30, more specifically, the possession, distribution, sale, or delivery of marijuana and cocaine. b. was found in close proximity to said marijuana and cocaine; or c. represents proceeds derived or realized from said violation(s) of the Georgia Controlled Substances Act. More specifically, on April 15, 2014 Officer R. Barrett, responded to 100 Perimeter Trace #11025 in reference to a noise complaint that was called in by the courtesy officer. The cour tesy officer advised he had received a complaint from one of the neigh bors in reference to a loud party at apartment #11025. While standing outside of the apart ment they could hear several people inside the apartment talking very loudly. Upon knocking on the door a male came to the door and asked "who is it', we responded "Dun woody Police". The male then walked off and did not come back to the door for a short period of time. A male, later identified as Sinclair Basnight, fi nally came to the door and we ad vised that we were there in reference to a noise complaint. Basnight ad vised that they were getting ready to go out to the club and got a little car ried away. When Basnight opened the door an overwhelming odor of burnt marijuana came from the apart ment. Another male, later identified as Lij Headly, walked up to the door next to Basnight. Headly stated they were just smoking a little weed be fore going out to the club so they did not have to smoke in the club. While talking with Basnight and Headly there were five other subjects walking around the apartment. While talking with Basnight about the marijuana smell he stated they already smoked what they had and they didn't have any more. He then brought us a small glass cup that had several small pieces of burnt marijuana cigarettes and ashes in the bottom. He stated that was all that was left. While talking with Basnight they asked for consent to search his apartment for any other marijuana he might have. He stated that he just wanted to leave and go to the club. He then kept asking questions about what would happen and we advised him that he could give us consent to search his apartment or we could ob tain a warrant. The entire time the front door to Basnight's apartment was open and the odor of burnt marijuana did not go away. There was also an odor of raw marijuana also coming from inside the apart ment. While waiting for him to decide they had Chatt Comm contact DeKalb County Dispatch and obtain which Magistrate Judge was on call. A short time later they advised that Judge He advised her of the situation and she stated that the on call Magistrate Judge is for violent crimes like Murder, Armed Robbery or Aggrav ated Assault and then she hung up on me. They then advised Basnight of the situation. The suspected marijuana was taken and I placed it into evidence at Dunwoody Headquarters for testing. Basnight stated that he is the only one on the lease. A male, later identi fied Michael Giralde that was in the bedroom on the left as you enter the apartment advised that he stays there whenever he comes to town. Giralde and Basnight also advised that they both have weapons in the apartment. Basnight advised his is a pistol and it was in his back pack. Giralde advised that his pistol was in the bedroom. Headly also advised that he does not live there but stays at the apartment when he comes to town. The other subjects in the house advised they were just in town to vis it. We checked all subjects on GCIC and Headley had an outstanding war rant out of Miami for a traffic violation but they would not extradite him. All subjects were released at the scene. On 04/15/14 Officer R. Barrett, re sponded to Dekalb County Magis trates Officer and secured a search warrant for 100 Perimter Trace #11025, the Heights Apts. The search warrant was signed by Magis trate Judge P. Williams, search war rant number 14-SW-000342. On 04/16/14 Officer R Barrett served a search warrant at 100 Perimeter Trace #11025 the Heights Apart ments. The other officers there were Sgt Furman, Sgt Belt, Officer J. Lewis, Dekalb Sheriff's Deputy Bell and Sandy Springs K9 Officer M. DeWald. At approximately 1930 hrs Officer Barrett knocked and announced Dun woody Police, search warrant. He did this twice with no reply. They then opened the door with the key provided by the complex and Officer Barrett again announced Dunwoody Police, search warrant, without any reply. They then cleared the apart ment to make sure no one was hid ing. The apartment had a very strong odor of marijuana coming from it. Once the apartment was cleared we then searched the apartment In the master bedroom officer Barrett located a Georgia Power bill with the name Sinclair Basnight on it. It was located in the small two drawer night stand next to the bed. In the same drawer he located a small black box with the word Micro on the outside. When looking inside the box he loc ated a small round plastic container that contained a greenish brown col or wax or paste like substance. On the floor next to the bed we located a Ruger 9MM pistol with holster. The pistol was fully loaded. In one of the dresser drawer we found visa gift cards. In the master bathroom Officer Bar rett located a clear plastic baggy with suspected marijuana inside. The clear plastic baggy was sitting on the counter on top of a magazine. While searching the master bedroom closet he located a Florida Driver's License in a coat pocket with the name of Jason Tribeca, 02/24/88, with a Flor- ida License number of T925252887230. A later check of that license number showed it not on file. The license had a picture of Bas night on it. While searching the other bedroom they located a Sig Sauer 9MM pistol, fully loaded, on the floor partially un der the bed on the side closest to the window. On the nightstand next to the bed a Georgia Driver's license was found for Michael Giralde. Also in an ashtray on the night stand Of ficer Barrett found a partially burnt hand rolled marijuana cigarette. A fur ther search of the room he located a Department of Justice letter address to Lij Headley in reference to an ap peal for a gun permit. They also found a couple of containers that had marijuana residue in them along with a small try that also had marijuana
