Civil Motions Calendar scheduled for

that time. The Court hereby advises
all parties that a corporation must be
represented by an attorney in any
civil proceeding in this Court. Eckles
v. Atlanta Technology Group, Inc.,
267 Ga. 801, 485 S.E.2d 22 (1997).

Counsel and pro se litigants in all lis
ted cases are directed to appear in
Court for the Civil Non-Jury Trial Cal
endar on October 8, 2014, at 9:00
A.M. in Courtroom B on the Second
Floor of the Judicial Tower, located at
556 N. McDonough Street, Decatur,
Georgia 30030. Corporations must
be represented by counsel in all ac
tions filed on or after June 5, 1997.
Eckles v. Atlanta Technology Group,
Inc., 267 Ga. 801, 485 S.E. 2d 22
(1997). Counsel and parties should
appear with their witnesses, ready to
proceed to trial at that time. All con
flicts shall be handled as required by
Georgia Uniform Court Rule 17.1. At
tendees at the Non-Jury Trial Calen
dar must have express authority to
settle the pending claim(s) and must
be prepared to confidentially reveal
the terms of settlement to the Court.
The removal of a case for any reas
on from the Non-Jury Trial Calendar
shall be by Order of the Court only. A
Motion for Continuance must be
made in writing at least ten days be
fore trial, and an Order must be sub
mitted. If a case is settled or other
wise resolved, the parties must notify
Jacqueline Simpson, Civil Case

countyga.gov, and follow-up with a
pleading confirming dismissal or set
tlement.
All Motions or Demands for a Jury
Trial shall be made in writing as a
separate pleading filed with the Clerk
of State Court, and a copy served on
the opposing parties, at least ten (10)
days prior to the non-jury trial date
shown herein. If a jury trial is not so
demanded, then a party shall be
deemed to have waived the right to
trial by jury for damages pursuant to
Collins v. Jones, 197 Ga. App. 839,
399 S.E.2d 546(1990).

(Civil Pre-Trial
Conference Calendar)
Counsel and pro se litigants in all lis
ted cases are directed to appear in
Court for the Division VII Civil Pre-tri
al Conference Calendar on October
8, 2014, at 1:30 p.m. The purpose of
this Conference is to determine the
status of the case, resolve remaining
issues, and schedule the case for tri
al. A consolidated Pre-Trial Order
will be due sixty (60) days before
trial, but the Order need not be
prepared for the Pre-Trial Confer
ence.
At the Pre-trial Conference, counsel
and parties representing themselves
must be prepared to address any re
maining discovery issues, all pending
or anticipated motions, chances of
settlement, length of trial, number of
jurors, jury pre-qualifications, and
court reporting of the case. Counsel
and parties are expected to confer,
exchange documents and resolve
any discovery disputes. Further, they
must have express authority to settle
the pending claim(s) and be pre
pared to confidentially reveal the
terms of settlement to the Court.

All cases should expect to be
reached during the week of trial.
Cases may be called out of order as
scheduling demands. Parties are dir
ected to contact Marie Hall, Case
Manager at 404-687-7135 regarding
the calendar, trial matters and in
structions.
Parties must submit a Consolid
ated Pretrial Order by September
22, 2014 in conformity with Uniform
State Court Rule 7.2. Failure to re
spond to this calendar, or to file the
proposed Consolidated Pretrial Or
der may result in the DISMISSAL of
the complaint, answer, counterclaim,
cross claim or third party as appropri
ate.
Lead Counsel is required to be
present at the Mandatory Pretrial
Conference on October 6, 2014 at
3:00 p.m. The Parties are instructed
to discuss settlement options prior to
the Pretrial Conference. Prior to trial,
counsel shall make a good faith ef
fort to resolve any objections in de
positions to be presented at trial. All
unresolved objections, together
with argument and citations, shall
be filed, with a copy to the Court,
no later than five days prior to trial.
Any objections not brought before the
Court prior to trial shall be deemed
waived. All Motions in Limine shall
be filed on or before September 22,
2014.
The removal of a case from the tri
al calendar for any reason shall
ONLY be by Order of the Court. A
Motion for Continuance and/or Exten
sion of Discovery must be by con
sent of all parties and a Consent Or
der submitted, at the same time as
the Motion is filed with the Clerk of
the Court.
