More specifically, on November 8, 2011 Officer R.R. Weber # 2829 was patrolling the area of Redan Trail and Redan Road. At that time Officer Weber observed a Silver Chevy Co balt occupied by a Black male travel ing Westbound on Redan Road. Of ficer Weber noticed that the Black male was not wearing a seat belt and was smoking a Brown cigar. Officer Weber then got behind the vehicle at a Red light at the intersection of Redan Road and Fieldgreen Drive and attempted to initiate a traffic stop. The vehicle then pulled to the left side of the road into oncoming traffic and began driving away from Officer Weber through a Red traffic signal. Officer Weber then pursued the vehicle into a neighborhood in the area of Nimblewood way. As officer Weber was looking for the vehicle cit izens in the area informed Officer Weber of location of the vehicle. Of ficer Weber then observed the vehicle pulling into the driveway of 956 Willow Run. At that time Officer Weber observed the Black male jump out of the vehicle as it was still mov ing while carrying a dark colored bag in his hands. Officer Weber then pur sued the Black male on foot throughout the neighborhood and ob served the Black male throw the dark colored bag he was carrying behind a house. After a brief foot chase Of ficer Weber was able to take the Black male into custody after a Taser device was deployed. The Black male who was identified as ++Mr. An- rique Rashaad Zachary++ stated to Officer Weber that the only reason he ran was because he was smoking a “Blunt” (marijuana Cigarette) and he didn’t have a driver’s license. The dark colored bag that Mr. Zachary threw behind the house while he was running was recovered by Officer Duren and identified by Officer Weber. Officer Duren looked through the bag and located 2 bags that con tained a White chalky substance, a pill bottle and a Bersa .380 caliber handgun. Mr. Zachary stated to of ficers that the dark bag was not his and that he threw down a shirt in the area of the bag. Officers went back to the area where the bag was re covered but did not observe a shirt at the location. A pat down of Mr. Zachary revealed 1 large stack of money in his left front pocket and 2 stacks in his right front pocket. The white chalky substance field tested positive for cocaine and had a field weight of 51.52 grams. The green leafy substance which was later iden tified as marijuana weighed approx imately 28 grams. Mr. Zachary was arrested and trans ported to the DeKalb County jail for Obstruction of a law enforcement of ficer, Trafficking cocaine, possession of marijuana and driving without a li cense. The U.S. currency that was seized at the scene was transported to BB&T Bank where it was counted by an employee and determined to be $828.00. The currency was then deposited in an account at the bank. Zachary was charged with Violation of the Georgia Controlled Sub stances Act. The cocaine and marijuana are subject to forfeiture pursuant to O.C.G.A. § 16-13- 49(d)(1). The currency is subject to forfeiture pursuant to O.C.G.A. § 16- 13-49(d)(2) and (d)(6). The weapon is subject to forfeiture pursuant to O.C.G.A. § 16-13-49(d)(4). More specifically, on November 17, 2011 Atlanta Police were conducting a supervised safety check point at Maynard Terrace at Memorial Drive. A blue Chevrolet Lumina ap proached the checkpoint and the driver later identified as ++Antonio Boswell++ presented Atlanta Police with a paper copy of a Georgia Identi fication card. Atlanta Police asked Mr. Boswell for his driver’s license and Mr. Boswell informed Atlanta Po lice he didn’t have his license on his person. During a check of Mr. Boswell driver’s license, Atlanta Po lice discovered he was unlicensed. While speaking with Mr. Boswell At lanta Police could smell an odor of raw marijuana coming from inside the vehicle. Atlanta Police removed Mr. Boswell from the vehicle and in formed him he was under arrest for driving without a license. Atlanta Po lice recovered 2 black plastic trash bags which contained thirteen indi vidual sealed gallon size clear plastic zip lock bags of suspected marijuana, approximately 13 pounds, sitting in a child’s seat next to Mr. Boswell’s son in the rear seat of the vehicle. At lanta Police also recovered $2,790.00 in U.S. Currency from the person of Mr. Boswell. Boswell was charged with Violation of the Georgia Controlled Substances Act. The marijuana is subject to for feiture pursuant to O.C.G.A. § 16-13- 49(d)(1). The currency is subject to forfeiture pursuant to O.C.G.A. § 16- 13-49(d)(2).
