ity Deed (hereinafter referred to as
the "Property”):
All that tract or parcel of land lying
and being in Land Lot 361 of the 18th
District, DeKalb County, Georgia, be
ing Lot 7, Block J, Village Mill Sub
division, Unit Two, as per plat recor
ded in plat book 54, page 69, DeKalb
County, Georgia records, which plat
is incorporated herein and made a
part hereof, together with all build
ings and improvements thereon the
“Property”).
This Property is conveyed subject to
those matters set forth as follows:

and Leslie E. Kopel to Union Plant
ers Bank, N.A., in the original princip
al amount of $270,000.00, executed
March 11, 2003, filed April 16, 2003,
recorded in Deed Book 14472, Page
354, DeKalb County, Georgia Re
cords.
Security Deed from David P. Kopel
and Leslie E. Kopel to Fidelity Bank,
in the original principal amount of
$50,000.00, executed August 3,
2004, filed September 9, 2004, recor
ded in Deed Book 16571, Page 510,
DeKalb County, Georgia Records.
Subject to all matters as shown on
that certain plat recorded in Plat Book
54, Page 69, DeKalb County, Geor
gia Records.
The above-referenced Property will
be sold subject to the following: all, if
any, outstanding ad valorem taxes
and/or assessments; all, if any, other
prior liens, easements, covenants, re
strictions, encumbrances, zoning or
dinances or other matters of record to
which the Security Deed is junior in
priority; and all, if any, matters affect
ing said Property which would be dis
closed by an accurate survey and in
spection of said Property. Said Prop
erty will be sold as the Property of
David P. Kopel and Leslie E. Kopel,
and the proceeds will be applied to
the payment of the described in
debtedness, Security Deed and all
expenses of this sale. Any remaining
proceeds will be applied pursuant to
the laws of the State of Georgia.
The above-referenced Property will
be sold on an "as is, where is” basis
without recourse against Grantee and
without representation or warranty of
any kind or nature whatsoever by
Grantee with respect thereto.
To the best of the undersigned’s
knowledge and belief, the Property is
presently owned by David P. Kopel
and Leslie E. Kopel, who are the
parties in possession or a tenant or
