Zejnelovic of the Chamblee Police
Department:

heroin; and

Conduct giving rise to said seizure
was as follows:

tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of
heroin, cocaine and marijuana.
b. was found in close proximity to
said heroin, cocaine, and marijuana;
or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, on December 26,
2014 Officer Zejnelovic performed a
traffic stop on a vehicle driven by
Nickie Burt, the fron passenger was
Mario DeAngelo James. According to
GCIC, the vehicle driven by Nickie
Burt had a suspended registration.
As Officer Zejnelovic approached the
vehicle and smelled a strong odor of
marijuana coming from inside the
vehicle and asked the occupants of
the vehicle about the smell. The ad
mitted that he had just smoked some
marijuana in the car.
Officer Zejnelovic asked both occu
pants to exit the vehicle and conduc
ted a search incident to impound.
During the course of his search Of
ficer Zejnelovic recovered 17.6 grams
of heroin, 27.7 grams of crack co
caine, and 2.2 grams of marijuana
from a small blue shopping bag loc
ated on the right passenger floor
board.
Both occupants were arrested and
charged with various VGCSA
charges, to include trafficking heroin.
Mario DeAngelo James had
$1,780.00 in U.S. Currency in his
front pockets which in the opinion of
Officer Zejnelovic are proceeds from
the illegal sales of narcotics.
++James and Burt++ were charged
with Violation of the Georgia Con
trolled Substances Act. The heroin,
cocaine, and marijuana are subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(1). The currency is subject
to forfeiture pursuant to O.C.G.A. §
16-13-49(d)(2) and (d)(6). Pursuant
to O.C.G.A. § 16-13-49(n)(3), any
claim to the seized property must be
sent within thirty days to the seizing
law enforcement agency AND to As
sistant District Attorney, Rita B.

arrival, he met with ++Cory
Herrod++, who advised he had been
shot and assaulted by a known asso
ciate he referred to as “Ant G”. Mr.
Herrod’s head and torso was com
pletely covered in blood. Mr. Herrod
stated that he invited “Ant G” to his
apartment and while they were in
side the apartment, “Ant G” suddenly
struck him in the head with a bottle.
Herrod stated that he then heard a
gunshot and noticed that he had
been shot in the arm, at which time
he ran to his neighbor, Abdihkim
Ali’s, apartment to get help. Upon
EMS responding to the scene, Her
rod was transported to Grady Me
morial Hospital to receive medical
care.
The Officer conducted a sweep of the
apartment to assure there were no
other victims or suspects inside.
Upon conducting this security sweep,
He observed blood splatter
throughout the hallway and apart
ment and the liquor bottle and hand
gun. He also observed there to be a
large amount of Cocaine on the kit
chen counter in plain view. Major
Felony Detective Quigley was contac
ted and responded out to the incid
ent location; and upon being briefed,
He then contacted the Narcotics Divi
sion, at which time Det. Fitzgerald,
Det. Ricketts and Sgt. Franklin re
sponded to the location and upon be
ing advised of the criminal activity
and observing and testing the Co
caine, they seized a total of 212
grams of Cocaine which were loc
ated in a large bag, a zip lock bag
and a family dollar sandwich bag all
located on the kitchen counter. They
also seized 119 grams of Marijuana,
which was located on the kitchen
floor, a box of food saver vacuum
seal bags located in an open cabinet,
a Ziploc Vacuum sealer and a black
digital scale containing white residue
suspected to be cocaine located on
the kitchen counter top,
Detective Fitzgerald responded to the
neighbor, Mr. Ali’s apartment, and
after Ali waived his rights, He ad
vised His neighbor, Harrod, had got
ten shot and dropped off a jacket full
of money and advised him to hold it
for him. Mr. Ali signed a Disclaimer of
Ownership Form, advising the money
did not belong to him and he did not
want to keep it at his house. Upon
being shown the money, Det. Fitzger
ald observed the USC to be behind
the front door in a jacket and satur
ated with blood. The money was
seized at that time.
Detective Fitzgerald also obtained a
written statement, given voluntarily
from the next door neighbor, Penny
Arnold-Baker, in apartment 1836 ad
vising that the suspect Herrod has
been residing in apartment 1838 for
