Pursuant to O.C.G.A. § 16-13-49(n),
you are hereby notified that on Feb
ruary 24, 2015 the property de
scribed below was seized during an
investigative arrest at Chamblee
Tucker Road and Embry Circle,
DeKalb County, Georgia by Detect
ive M.D. Crews of the DeKalb County
Police Department:
a. Approximately 6.7 grams of
methamphetamine; and
b. Approximately 11.5 grams of crack
cocaine; and
c. Approximately 12.5 grams of
powder cocaine; and
d. Approximately 1.9 grams of
marijuana; and
e. Five hundred seventy dollars
($570.00) in U.S. Currency; and
f. Digital scale.
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of
methamphetamine, crack cocaine,
powder cocaine and marijuana.
b. was found in close proximity to
said methamphetamine, crack co
caine, powder cocaine and
marijuana; or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, on February 24,
2015, Officer DeJarnette was work
ing in an undercover capacity at the
Super 8 Motel when he observed a
male arrive in a silver Kia make con
tact with another subject in a hotel
room and leave 1-2 minutes later, ac
tions consistent with illegal drug
activity. Due to this suspicious activ
ity, mobile surveillance was set up on
the vehicle, which was observed
leaving the Super 8 and going to the
Motel 6, where a male subject walked
up to the Kia got into the passenger
seat and exit 1-2 minutes later. Upon
observing this behavior, Officer Cin
tron, who was operating a marked
unit, got behind the Kia, at which time
the driver, upon observing Cintron
behind him, immediately turned into
the McDonalds parking lot and pull
up in the drive-through. Upon Officer
Cintron driving past McDonalds, the
driver quickly exited the drive-through
and exited the parking lot where he
was later observed by Officer DeJar
nette running the Red light in an at
tempt to get out of the area. Officers
Craig and Batchelder, who was
patrolling the area of Chamblee Tuck
er Road and Embry Circle were aler
ted of the situation and caught up to
the vehicle on Interstate 285 near
Northlake Parkway and initiated a
traffic stop. Officers Craig and
Batchelder exited the patrol vehicle
and approached the suspect’s
vehicle. As they walked up to the
driver side of the vehicle, Officer
Craig observed the driver, later identi
fied as ++Daimone Smith + + ,
hanging his head out of the driver
side window and watching him walk
towards his vehicle. Officer Craig
gave Smith a verbal command to let
him see his hands. Smith immedi
ately pulled his head back into his
vehicle and proceeded to flee the
traffic stop, traveling at a high rate of
speed and cutting off numerous
vehicles in the process. The pave
ment was wet from previous rain and
it was currently drizzling at the time of
the traffic stop making his maneuver
more hazardous and reckless.
Officers Craig and Batchelder ran
back to their patrol vehicle where
they immediately attempted to pur
sue Smith. Smith was traveling so
reckless that the chase was termin
ated to avoid undue risk to civilians.
Officer Craig was able to observe,
from a distance, that Smith's vehicle
turned right onto Henderson Mill
Road, so he gave a lookout over the
Police radio to other surrounding
units. Shortly after providing the
lookout, Officer K. Cintron came over
the Police radio and advised he loc
ated Smith's vehicle turning into the
church parking lot and as Smith ob
served the police unit he quickly ex
ited the vehicle, while holding a white
bag, and began to flee on foot to the
rear of the Church. Officer Cintron ex
ited the Patrol unit and gave chase
while updating the units of Smith’s
direction of travel and his clothing.
A perimeter was established and Po
lice K9 was requested. Prior to the
police K9 arriving on scene, near
Henderson Mill Road and Midvale
Road, Officer Craig observed a male,
matching the description provided by
Officer Cintron, slowly walking out of
a tunnel at the creek bed which ex
tended underneath Henderson Mill
Road. As Officer Craig got closer to
the individual, he immediately recog
nized the individual to be the subject
he had pulled over, Daimone Smith.
Upon Smith observing the Officers,
he immediately stepped back into the
tunnel and out of the Officer’s view.
Officers Batchelder and Craig exited
their patrol vehicle and proceeded to
take a tactical position on each side
of the tunnel in an attempt to keep
Smith contained within. Shortly after
setting up on the tunnel, the Officers
took Smith into custody; however,
they observed that he did not have
the bag he was seen fleeing with.
Due to this observation, the Officers
had the K-9 to conduct an article
search of the area between where
Smith had exited his vehicle and
where he was located. Upon con
ducting this search, K-9 Tico located
a white camera bag with a green
strap. The bag was being concealed
under a rock, behind a tree, under an
embankment to the creek near the
tunnel, which was located between
the location where the suspect was
observed running and the location
where the suspect was taken into
custody.
Upon inspecting the interior of the
case, they located a large plastic
bag, which contained four (4) smaller
bags each containing approximately
6.7 grams of Methamphetamine, 11.5
grams of crack cocaine, 12.5 grams
of powder cocaine and 1.9 grams of
marijuana. Also in the camera case
was a digital scale and a clear glass
bottle containing a white powdery
cutting agent used for making crack
cocaine. Officers seized an undeter
mined amount of U.S. Currency
which was located in Smith’s pock
ets.
Smith was arrested and transported
to DeKalb County Jail. The U.S. cur
rency was transported to BB&T Bank
where it was counted by an employ
ee and determined to be $570.00.
The currency was then deposited in
an account at the bank.
Smith was charged with Violation of
the Georgia Controlled Substances
Act. The methamphetamine, crack
cocaine, powder cocaine and
marijuana are subject to forfeiture
pursuant to O.C.G.A. § 16-13-
49(d)(1). The currency is subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(2) and (d)(6).
Pursuant to O.C.G.A. § 16-13-
49(n)(3), any claim to the seized
property must be sent within thirty
days to the seizing law enforcement
agency AND to Assistant District At

Pursuant to O.C.G.A. § 16-13-49(n),
you are hereby notified that on Feb
ruary 27, 2015, the property de
scribed below was seized at 151
Cateret Place, DeKalb County, Geor
gia by Detective M.D. Crews of the
DeKalb County Police Department:
a. Approximately 1.3 pounds of
marijuana; and
b. Approximately 6.7 grams of crack
and powder cocaine; and
c. Approximately 13 MDMA pills; and
d. Approximately .6 gram of powder
MDMA; and
e. Approximately 27 oxycontin/oxy-
codone pills; and
f. Six hundred sixty dollars ($660.00)
in U.S. Currency; and
g. Kimber .223 assault rifle, SER#
RA434606; and
h. .357 Magnum, SER# 36689; and
i. Digital scale.
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery of
marijuana, crack/powder cocaine,
MDMA pills, oxycontin/oxycodone
pills and powder MDMA.
b. was found in close proximity to
