20887, Page 341, Dekalb County,
Georgia records on June 17, 2008,
as modified by that certain Modifica
tion of Security Deed, recorded in
Deed Book 22948, Page 492, Dekalb
County, Georgia on March 29, 2012,
as assigned to Bouldercrest Invest
ments, LLC by an Assignment Agree
ment Without Recourse, Representa
tion or Warranty, dated May 28,
2015, recorded in Deed Book
, Page , Dekalb County,
Georgia, and further assigned from
Bouldercrest Investments, LLC to
MSJ Rex Holdings, LLC by an As
signment Agreement Without Re
course, Representation or Warranty,
dated June 1, 2015, recorded in
Deed Book , Page ,
Dekalb County, Georgia conveying
the after-described property to se
cure a Note in the original principal
amount of four hundred twelve thou
sand two hundred fifty dollars,
$412,250.00, with interest thereon as
set forth therein, there will be sold at
public outcry to the highest bidder, for
cash, before the courthouse door of
Dekalb County, Georgia, within the
legal hours of sale on the first Tues
day in July, 2015 - July 7, 2015 - the
following described property:
All that tract or parcel of land lying
and being in Land Lot 89 of the 15th
District, Dekalb County, Georgia, and
being more particularly described as
follows:
Beginning at a point on the northeast
erly right-of-way of Flat Shoals Road,
(State Route 155), 281.7 feet south
easterly, as measured along the
northeasterly right-of-way of Flat
Shoals Road, from the southerly limit
of access and right-of-way at I-285,
said point of beginning also being the
southwest corner of property now or
formerly owned by L.J. Gower, run
ning thence easterly along the south
boundary of said Gower property
253.1 feet to a point; thence south
erly 100 feet to a point thence south
westerly 150 feet to a point on the
northeasterly right-of-way of Flat
Shoals Road which is 163.3 feet
southeasterly, as measured along the
northeasterly right-of-way of Flat
Shoals Road from the point of begin
ning; being improved property and
having a one-story brick building loc
ated there on, and being known as
3806 Flat Shoals Parkway according
to the present system of numbering
in Dekalb County, Georgia.
The debt secured by said Security
Deed has been and is hereby de
clared due because of, among other
possible events of default, failure to
pay the indebtedness as and when
due and in the manner provided in
the Note and Security Deed. The
debt remaining in default, this sale
will be made for the purpose of pay
ing the same and all expenses of this
sale, as provided in the Security
Deed and by law, including attorney’s
fees (notice of intent to collect attor
ney’s fees having been given).
Said property will be sold subject to
any outstanding ad valorem taxes (in
cluding taxes which are a lien, but not
yet due and payable), any matters
which might be disclosed by an ac
curate survey and inspection of the
property, any assessments, liens, en
cumbrances, zoning ordinances, re
strictions, covenants, and matters of
record superior to the Security Deed
first set out above.
MSJ Rex Holdings, LLC is the holder
of the Note and Security Deed to the
property. In accordance with
O.C.G.A. § 44-14-162.2, the entity
that has full authority to negotiate,
amend, and modify all terms of the
mortgage with the debtor is: MSJ Rex
Holdings, LLC, 1550 North Brown Rd,
Ste 130, Lawrenceville, GA 30043,

To the best knowledge and belief of
the undersigned, the party in posses
sion of the property is Jerry & Sons
Enterprises, Inc., or a tenant or ten
ants thereof, and said property is
more commonly known as 3806 Flat
Shoals Parkway, Decatur, Dekalb
County, Georgia 30034.
This sale will be conducted subject
(1) to confirmation that the sale is not
prohibited under the U.S. Bankruptcy
Code and (2) to final confirmation
and audit of the status of the loan
with the holder of the Security Deed.
