As Officer Batchelder was exiting her
vehicle, she observed the back seat
passenger light a cigarette and as
she approached the Malibu, she
could see the driver moving around in
his seat, appearing as if he was
searching for something. Upon Of
ficer Batchelder making contact with
the driver, who was identified as
Christopher Hamlett, she advised the
driver the reason for the traffic stop
and inquired why he was driving so
erratically. The driver stated he was
in a rush to get home because he
had to take his girlfriend to work. Of
ficer Batchelder asked Hamlett for his
driver’s license as well as identifica
tion from all occupants of the vehicle.
Hamlett stated he did not have his
driver’s license on his person and
proceeded to provide her with his
name and date of birth. Officer
Batchelder returned to her patrol
vehicle where she conducted a
GCIC/NCIC check of Hamlett and the
vehicle’s other occupants.
Upon arrival of Officer Cintron, who
responded to assist, she returned to
the Malibu where she requested
Hamlett to step to the rear to speak
with her. Hamlett obliged and togeth
er they walked to the rear of the
vehicle, at which time Officer
Batchelder asked Hamlett if there
were any drugs or weapons inside
the vehicle. Hamlett stated there was
not. Officer Batchelder asked Ham
lett for verbal consent to search his
vehicle. Hamlett immediately indic
ated the vehicle belonged to the front
seat passenger’s wife but stated Of
ficer Batchelder could search the
vehicle if she wanted. Officer
Batchelder then asked Hamlett if he
had any drugs or weapons on his
person. Hamlett stated there was not
and provided her verbal consent to
search his person. Upon searching
Hamlett, she located 15 Oxycodone
pills in a small baggie in his front right
coin pocket, 6.1 grams of Marijuana
in a small baggie and 2 Percocet Pills
also in a small baggie located in his
front left pocket. She seized an un
determined amount of U.S. currency,
which was located in Hamlett’s front
right pocket. Hamlett was taken into
custody.
Upon returning to the Malibu, Officer
Batchelder asked the front seat pas
senger to step to the rear of the
vehicle and speak with her. The front
seat passenger obliged and stepped
to the rear with her. Officer Batcheld
er asked the front seat passenger to
be honest with her and asked him if
there were any other illegal drugs or
weapons in the vehicle. The front
seat passenger immediately stated
there was; and indicating they all be
longed to Hamlett. Officer Batchelder
asked for and was granted verbal
consent to search the front seat pas
senger. Officer Batchelder did not
locate any contraband on his person.
Officer Batchelder then asked the
rear passenger, identified as Amber
Aldrich, to exit the vehicle. Upon Aid-
rich exiting the vehicle, Officer K. Cin
tron observed a Mossberg 12 gauge
shotgun laying on the rear passen
ger floor board, under Aldrich and
Henderson’s, the other back seat
passenger, feet. Upon this discovery
Officer Fred, who also responded to
the scene to assist, removed Hender
son from the vehicle and conducted a
terry frisk of his person, which resul
ted in .7 grams of marijuana being
located in his front left pocket.
Upon searching the vehicle for other
firearms and illegal drugs, they loc
ated a loaded dock 22 .40 caliber
handgun, beneath the seat where
Henderson had been sitting. Upon in
quiring about the ownership of the
firearms, Hamlett advised that the
Mossberg Shot gun was in fact his,
but none of the occupants took own
ership of the Glock.
Detective Crews responded to the
scene. He seized the 2 firearms and
an undetermined amount of U. S.
Currency, which was located in Ham
lett’s front right pocket.
++Hamlett, Aldrich and Henderson++
were arrested and transported to
DeKalb County Jail. The U.S. cur
rency was transported to BB&T Bank
where it was counted by an employ
ee and determined to be $825.00.
The currency was then deposited in
an account at the bank.
Hamlett, Aldrich and Henderson were
charged with Violation of the Georgia
Controlled Substances Act. The oxy
codone pills, Percocet pills, and
marijuana are subject to forfeiture
pursuant to O.C.G.A. § 16-13-
49(d)(1). The currency is subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(2) and (d)(6). The weapons
are subject to forfeiture pursuant to
O.C.G.A. § 16-13-49(d)(4).
Pursuant to O.C.G.A. § 16-13-
49(n)(3), any claim to the seized
property must be sent within thirty
days to the seizing law enforcement
agency AND to Assistant District At
torney, Rita B. Lewis, by certified
mail, return receipt requested.

Pursuant to O.C.G.A. § 16-13-49(n),
you are hereby notified that on March
27, 2015, the property described be
low was seized during a traffic stop
on I-285 South and Hwy. 78 West,
DeKalb County, Georgia by Detect
ive J. R. Browder of the DeKalb
County Police Department:
1. Approximately 1 pound of
methamphetamine; and
2. Two thousand dollars ($2,000.00)
in U.S. Currency.
Conduct giving rise to said seizure
was as follows:
Said property:
a. was directly or indirectly used or in
tended for use to facilitate a violation
of the Georgia Controlled Sub
stances Act, O.C.G.A. § 16-13-30,
more specifically, the possession,
distribution, sale, or delivery
methamphetamine.
b. was found in close proximity to
said methamphetamine; or
c. represents proceeds derived or
realized from said violation(s) of the
Georgia Controlled Substances Act.
More specifically, On March 25,
2015, Det. Browder of the Atlanta
HIDTA Group 2 assisted the DEA
Nashville Tennessee Bureau of In
vestigation with a controlled buy in
unincorporated DeKalb County
between their Confidential Source
and a known drug dealer. The Con
fidential Source called his contact,
the middle man, who was identified
as Chris Holt, to set up a transaction
between him, the Confidential Source
and the Source of Supply, who was
identified as Jesus Castillo. Holt ad
vised the Confidential Source to go to
the Wendy’s restaurant, located at
3504 Chamblee Tucker Rd.,
Chamblee, Ga., and order him (Holt)
some food and they would meet him
there. Upon the arrangements being
made, the Agents and Detectives set
up surveillance at Castillo’s resid
ence located at 3341 Chamblee
Tucker Rd. Apt. #3, Tucker, and the
Wendy’s restaurant.
The Confidential Source went to the
Wendy’s location and ordered the
food, which was placed in a white
Wendy’s plastic bag. Approximately
26 minutes later, TFO Fregosi ob
served Castillo exit his residence and
enter a blue Toyota Tundra, at which
time mobile surveillance started on
Castillo. He was observed leaving his
apartment complex and driving dir
ectly to the Wendy’s location where
he was observed going and meeting
with the Confidential Source where a
recorded meeting took place that led
to Castillo selling the Confidential
Source 1 pound of Methamphetam
ine in exchange for $4000.00 in U.S.
currency, which was derived from the
Operation Agency Fund.
While this meeting was taking place,
Agent Fregosi, who was surveillan-
cing the residence, observed a green
Chevy Truck arrive to Castillo’s resid
ence. He observed the driver, who
was identified as Clifton Burns, go to
the door and knock. Upon no one an
swering, he reentered the truck and
was observed leaving the apartment
complex and driving to the parking lot
of the nearby Planet Fitness, located
at 3535 Chamblee Tucker Rd. After
the completion of the meeting with
the Confidential Source, Castillo was
observed leaving Wendy's, with the
white plastic Wendy’s bag that con
tained the food the Confidential
Source was asked to purchase, and
returning to his residence. Several
minutes after Castillo arrived home,
++Chris Holt++, driving a black Nis
san Maxima, arrived to the residence
and parked, at which time Castillo
was observed exiting his residence,
carrying the plastic Wendy’s bag, and
entering the passenger side of the
Maxima. Several minutes later
Castillo was observed exiting the
Maxima, without the Wendy’s bag,
and returning to his residence. Holt
left the apartment complex, where
mobile surveillance began, and im
mediately drove to the Planet Fit
ness location. Upon arriving at the
Planet Fitness, Burns, the driver of
the Chevy, was observed getting into
the passenger side of the Maxima.
Several minutes later, Burns was ob
served exiting the Maxima and going
back to his truck carrying the same
Wendy's bag Castillo was seen deliv
ering to Holt.
Upon them leaving the location mo
bile surveillance was set up on both
Holt and Burns. As Burns got onto I-
285 SB, Georgia State Patrol Troop
er Ennis conducted a traffic stop on
him and upon conducting a prelimin
ary investigation, which included the
K-9 making a positive alert to the
presence of illegal narcotics during
an open air exterior sniff, the plastic
Wendy’s bag was located on the front
passenger seat and it contained 1
pound of Methamphetamine.
Upon the Officers validating that the
bag contained methamphetamine,
Georgia State Trooper Lipham pulled
Holt over for a window tint violation.
Upon conducting his preliminary in
vestigation which showed Hold win
dow at an illegal tint of 16%, He
asked Holt for consent to search his
Maxima, which Holt denied consent.
However, due to the illegal transac
tions that took place, Trooper Lipham
had his K-9 to conduct an open air
sniff of the exterior of the vehicle,
which yielded a positive alert. Upon
searching the vehicle, they located
an undetermined amount of U.S. cur
rency in the center console, which
was turned over to DeKalb County
Detective Browder of the Atlanta
HIDTA Unit for forfeiture.
Due to the nexus that was able to be
established between Castillo and the
1 pound of Methamphetamine that
was located in Burns’ truck, Castillo
was pulled over and arrested shortly
after he left his residence and
entered 285 SB. A search warrant
was granted for Castillo’s residence,
which yielded more than a gram of
Methamphetamine (GBI weight
pending) being located in a jacket
pocket in the bedroom closet and
more than a gram of Methyl Sulfony
Methane (GBI weight pending) loc
ated in a pair of shorts in the same
closet. They also located the
$4000.00 OAF Funds which were
paid to Castillo by the Confidential
Source. This $4000.00 was located
behind a picture frame hanging on
the wall in Castillo’s bedroom.
Castillo, Burns and Holt were arres
ted and transported to DeKalb
County Jail. The U.S. currency was
transported to BB&T Bank where it
was counted by an employee and de
termined to be $2,000.00. Pursuant
to authorization of the District Attor
ney under O.C.G.A. § 16-13-
49(1 )(C), the currency was then de
posited in an account at the bank.
Castillo, Burns and Holt were
charged with Violation of the Georgia
Controlled Substances Act. The
methamphetamine is subject to for
feiture pursuant to O.C.G.A. § 16-13-
49(d)(1). The currency is subject to
forfeiture pursuant to O.C.G.A. § 16-
13-49(d)(2) and (d)(6
