This Grand Jury, sworn in by the
Honorable Clarence F. Seeliger in
the DeKalb Superior Court on Janu
ary 5, 2016 respectfully submits the
following presentments.
INDICTMENTS
This Grand Jury was presented with
(372) cases during the January-Feb-
ruary 2016 term. Of these cases
(368) True Bills and (4) No Bills were
returned. An additional (192) cases
proceeded by Accusation.
REQUEST FOR PUBLICATION
Pursuant to the O.C.G.A. § 15-12-80,
we the presently constituted Grand
Jury recommend to the Honorable
Clarence F. Seeliger that these gen
eral presentments be published in
whole in the County Legal Organ.
Grand Jury Selection and Manage
ment Process
• The room used as the location for
the Grand Jury Summons was too
small. The room quickly ran out of
seats and many had to stand during
the grand jury selection process. We
recommend using a bigger room for
the summons and moving to the
smaller room once the grand jury has
been selected.
• We recommend attaching a FAQ to
the Grand Jury Summons to answer
basic questions such as what the dif
ference is between a Grand Jury
Summons and a Jury Summons.
• Upon arrival in the courthouse a
sign in the lobby says “Jury Duty” and
is misleading to grand jurors who
need to report on the 7th floor, we re
commend noting in the summons to
specifically NOT report to the 1st floor
and instead to the 7th.
• For grand jurors who serve, they
should be exempt for the selection
process for a time period of more
than 18 months. We recommend 5
years for grand jurors who served, 18
months for citizens who attended the
summons, said “Ready to Serve,”
and were not selected, and no ex
emption time for anyone who de
ferred or did not attend the summons.
• We suggest that special considera
tion be given to non-salaried workers,
healthcare professionals with a
private practice, and other small busi
ness owners. For those in the afore
mentioned groups, there was more
financial hardship for them than for
others.
General Observations
• We recommend shortening the term
to 6 weeks instead of 9, but making
each day fuller. We experienced sev
eral extremely short days and would
have preferred to have some lengthi
er days and a shorter term.
• If 26 jurors are selected and only 23
can be present, we recommend in
creasing the number of absences to
4 or 5 as we often had to remove a
juror from the room because we were
over the threshold of 23.
• We recommend adding a clock to
the wall to help keep track of time.
• We recommend adding a large map
of DeKalb County to the wall for ADA,
witness, and jury reference.
• We recommend hanging a white
board on the wall and encouraging
witnesses to use the whiteboard to
explain complicated cases. Often a
witness would mix up names while
telling the story and it was up to the
grand jury to piece the testimony to
gether correctly.
• As an observation, we noticed that
there was a great range of quality in
the witnesses’ ability to relay the
facts of the cases. Some were fant
astic story tellers and could paint a
picture with their words; while others
caused so much confusion that a
case that was not particularly com
plicated would be misunderstood or
even no-billed because the grand jury
had not been able to interpret the
testimony.
• We recommend changing the days
of service from Tuesday and
Thursday to two consecutive days of
the week, preferably at the beginning
or end of the week.
• We recommend adding a sound cue
like a buzzer to the on/off light switch
in both the DA’s room and the break
room. A sound would be a much
more efficient means to notify the
parties that a light has gone off.
There were a number of times that
both parties were ready to hear a
case, but the ADAs and witnesses
did not think the jury was ready.
• We recommend leaving a supply of
batteries in the jury room for the
grand jury to manage the micro
phone.
• Prior to the Officer Involved Shoot
ing cases, inform the grand jury that
the defendant and the defense attor
neys could be present. It was a shock
and surprise to many jurors to have
the defendant in the room during the
case. The process varied greatly from
the typical grand jury process and an
explanation of those differences be
fore the case would have been ap
preciated.
By far, the following three items
are the most important takeaways
and recommendations from our
Grand Jury term:
1. Explain “Probable Cause” in ex
haustive detail. Grand Jurors ini
tially did not understand the differ
ence between “Probable Cause” and
“Reasonable Doubt.” Examples, even
if fictional, should be presented to the
Grand Jury during orientation. At
least one additional time during the
term, an ADA should provide a re
fresher and additional examples to
help grand jurors understand this
concept.
2. Provide training and examples
about the most common felonies
that the grand jury will see during
their term. The guns and drugs
presentation during orientation was
helpful, but it did not help grand jur
ors understand the laws surrounding
the topics. The handout in the jury
handbook was useful as a reference,
but the grand jury should not be ex
pected to read and comprehend the
excerpt pages from the code. We re
commend a short series of con
densed presentations relating to the
most common infractions. For ex
ample, explain the difference
between Felony Murder and Malice
Murder BEFORE we hear a murder
case. Other examples: explain the
degrees of burglary; explain the pen
alties and thresholds for different
types of assault, battery, and theft.
We recommend that these presenta
tions do not happen on orientation
day and instead happen after grand
jurors have heard a few uncomplic
ated cases.
3. Ensure the presenting attorney
engages and clarifies witness’
statements. There were a number of
cases where the ADA did not ask cla
rification questions to the witness and
both the ADA and the jurors had diffi
culty in understanding the sequence
of events of the case. We encourage
that the ADA be familiar with the case
and that he or she asks relevant
questions to the witness for clarity.
Doing so not only expedites the testi
mony process but also the delibera
tion process.
