Book 17430, Page 438, DeKalb
County Records, said Security Deed
having been last sold, assigned,
transferred and conveyed to THE
BANK OF NEW YORK MELLON f/k/a
THE BANK OF NEW YORK as Trust
ee for FIRST HORIZON ALTERNAT
IVE MORTGAGE SECURITIES
TRUST 2005-AA6 by Assignment,
securing a Note in the original prin
cipal amount of $112,000.00, the
holder thereof pursuant to said Deed
and Note thereby secured has de
clared the entire amount of said in
debtedness due and payable and,
pursuant to the power of sale con
tained in said Deed, will on the first
Tuesday, April 5, 2016, during the
legal hours of sale, before the Court
house door in said County, sell at
public outcry to the highest bidder for
cash, the property described in said
Deed, to-wit:
All that tract or parcel of land lying
and being in Land Lot 194 of the 15th
District of DeKalb County, Georgia,
being all of Lot 106 and part of Lot
107, Block H, Unit Two, Woodridge
Subdivision, as per plat recorded in
Plat Book 56, Page 105, DeKalb
County Records, which plat is made
a part of this description by refer
ence thereto and being more particu
larly described as follows:
BEGINNING at an iron pin found at
the intersection of the northeasterly
right of way line of Cedar Ridge Court
(a 60' R/W) with the southeasterly
right of way line of Cedar Ridge Trail
(a 60' R/W); running thence north
easterly as measured along the
southeasterly right of way line of Ce
dar Ridge Trail, 124.05 feet to an iron
pin found at the northwest corner of
said Lot 106; running thence South
74 degrees 51 minutes east, 124.53
feet to an iron pin set; running thence
South 43 degrees 46 minutes 30
seconds west, 7.0 feet to an iron pin
found at the northeast corner of said
Lot 106; running thence South 12 de
grees 52 minutes west along the
easterly line of said Lot 106, 110.0
feet to an iron pin found on the north
easterly right of way line of Cedar
Ridge Court; running thence north
westerly as measured along the
northeasterly right of way line of Ce
dar Ridge Court, 123.56 feet TO THE
POINT OF BEGINNING; and being
improved property known as 4501
Cedar Ridge Trail, according to the
present system of numbering prop
erty in DeKalb County, Georgia. The
above-described property is more
particularly shown as delineated on
survey by Carter Land Surveying Co.
bearing the seal of James H. Carter,
GALS #1999, dated July 9, 1987,
which is incorporated herein by refer
ence as a part of this description.
Being the same property described in
that certain Deed Under Power recor
ded in Deed Book 16269, Page 73,
DeKalb County, Georgia records.
Said property is known as 4501 Ce
dar Ridge Trail, Stone Mountain,
GA 30083, together with all fixtures
and personal property attached to
and constituting a part of said prop
erty, if any.
Said property will be sold subject to
any outstanding ad valorem taxes (in
cluding taxes which are a lien, wheth
er or not now due and payable), the
right of redemption of any taxing au
thority, any matters which might be
disclosed by an accurate survey and
inspection of the property, any as
sessments, liens, encumbrances,
zoning ordinances, restrictions, cov
enants, and matters of record superi
or to the Security Deed first set out
above.
The proceeds of said sale will be ap
plied to the payment of said indebted
ness and all expenses of said sale as
provided in said Deed, and the bal
ance, if any, will be distributed as
provided by law.
The sale will be conducted subject
(1) to confirmation that the sale is not
prohibited under the U.S. Bankruptcy
Code and (2) to final confirmation
and audit of the status of the loan
with the secured creditor.
The property is or may be in the pos
session of Inell Santos and Ron San
tos, successor in interest or tenant(s).
