on Plat of Survey (supplemental plat)
dated December 19, 1975, made by
D.E. Hill Engineers, which plat is re
corded in Condominium Plat Book 3,
Page 128, DeKalb County Records,
which unit is a part of that property
shown on Plat of Survey dated
December 18, 1975, made by D.E.
Hill Engineers, which plat is recoded
in Condominium Plat Book 3, Page
124, DeKalb County Records, togeth
er with all right, title and interest of
grantor in said unit and the appurten
ances thereto under the Declaration
of Condominium of Orchard Lane I
dated July 2, 1973, recorded July 6,
1973 in Deed Book 3036, Page 176,
DeKalb County Georgia records, as
amended by amendments thereto
filed of record in the Office of the
Clerk of the Superior Court of DeKalb
County, Georgia, which plats, declar
ation and all recorded amendments
thereto are by reference incorpor
ated herein and made a part hereof.
The interest herein conveyed in
cludes, without limiting the generality
of the foregoing, an undivided
.7936% interest in the common areas
and facilities of Orchard Lane I as the
same is defined in said Declaration.
The debt secured by the Condomini
um lien, which totals $19,936.73 has
been and is hereby declared due be
cause of failure to pay the indebted
ness as and when due in the manner
provided for in the Amended and Re
stated Declaration of Condominium
for The Orchard Lane Condominium,
a Condominium, and the By-Laws.
The debt remaining in default, this
sale will be made for the purpose of
paying same and all expenses of the
sale, as provided in the Georgia Con
dominium Act, O.C.G.A. § 44-3-70,
et. seq., and the Amended and Re
stated Declaration of Condominium
for The Orchard Lane Condominium,
a Condominium (notice of attempt to
collect attorney's fees having been
given). The excess, if any, will be dis
tributed to the person or persons leg
ally entitled thereto.
To the best knowledge and belief of
the undersigned, the party (or parties)
in possession of the subject property
known as 3155 Tangerine Court,
Decatur, Georgia 30034 is Carlton H.
Gravesandy.
The unit will be sold subject to (a)
any outstanding ad valorem taxes, in
cluding taxes which are a lien but not
yet due and payable, (b) any matters
which might be disclosed by an ac
curate survey and inspection of the
property, (c) the Amended and Re
stated Declaration of Condominium
for The Orchard Lane Condominium,
a Condominium, and (d) all matters of
record superior to the Condominium
lien, including but not limited to, any
encumbrances, zoning ordinances,
restrictions, covenants and matters of
record superior to this Condominium
lien, including but not limited to, the
Security Deed from Carlton H.
