INJUNCTION DENIED
Judge Henry Decides the Cantrell and
West Metter
,IT IS A VERY INTERESTING CASE
The Applica’i n For Prmaufnt Injunction
Against the City of K- me Waa De
nied by Judge Henry.
L
I Judge Henry has denied the applica
' tion for injunction against the city in the
Cantrell & West case.
It will be remembered that this firm,
through its attorney >M. B. Eubanks,
raised a point that if decided favorably
meant a good deal to the city. The firm
was to show cause why it should not be
fined for doing business without license,
and Recorder Spullock held that the firm
was liable to the city.
The case was appealed to the city coun
cil, which body was sustained the re
corder.
Mr. Eubanks then applied to the
superior court for an iujunction restrain
ing the city from collecting the tax. The
point was made that it was against
the general tax act of 1894. The act in
question, so far as it refers to the present
controversy is as follow:
“Each agent or firm negotating loans
and charging therefore_shall pay a tax of
ten dollars to the state and no municipal
corporation or county authorities shall
levy any additional tax on said profession
either as a license fee or otherwise.”
After hearing the argument Judge Henry
held the city ordinances did not appear
in evidence to sustain the claims of the
movants for injunction. Judge Henrv
then over-ruled the motion praying for a
perdetual injunction.”
The case has attracted considerable at
ention, and may not yet be concluded.

GREAT SUCCESS
Is That Being Met With by Dr. Holmes in
Atlanta. -
Romans are pleased to note the great
success Dr. J. B. S. Holmes is meeting in
Atlanta.
In another column is a notice of the
convaksence of Mr. Crisp, who has been
at the Holmes’ Sanitarium, and below
will be found another clipping from the
Constitution:
“It will be a source of universal pleas
ure to her many friends throughout the
state to*learn that Mrs. Atkinson is rap
idly recovering from the effects of a very
serious but successful operation. She is
still at the Holmes Sanitarium, but in two
weeks will be able to resume her social
and domestic duties in the executive man
sion. She has overcome her recent suf
fering with that bravery and determina
tion that have characterized her in the
trials that have been put upon her, it be
ing little more than a year since she un
derwent the trying ordeal of the govern
or’s critical illness.”
