son, a 14-year-old boy, stabbed and
killed Bill Draper at a political meeting
at which Congressman W. G. Hunter
spoke. The boy hurrahed for Hunter
and Draper struck him, whereupon the
boy drew a knife and killed his assailant.

Ordered that the bill for lighting
the streets for the month of Septem
ber be referred to Mr. S. M. Lowry
with instructions to examine the bill
and with authority to have a draft
issued for the amount. Approved.
List of the following stated bonds
cancelled September 19, 1896, was
ordered spread upon the minutes and
the bonds were burned in the presence
of the Council : Bonds cancelled Sep
tember 19, 1896—Series “B ”1; Series
“ A ” 2; 53, 195, 196, 197.
The claim of George W. Wimpee
for damages for accident upon the
bridge over the Oostanaula river at
the foot of Second avenue was re
ferred to the city attorney with in
structions to investigate and report.
Ordered that a deed be made by the
city, executed by the mayor and clerk,
to the Fifth Ward Hose Company,
No. 4, for the lot now occupied by
them as a reel house and place of
meeting. (’he right, however, is re
served in the city to redeem said iot
and have the same reconveved to it
upon payment by the city of what
ever incumbrance may be placed upon
said lot by said company for the
purpose of making improvements
thereon.
Resolved, that the chairman of the
finance committee be instructed to
purchase from time to time bonds to
the amount of $63.70, being the
balance of the sinking fund of SSOOO
for the year 1895, and SSOOO for the
year 1896, less the amount charged to
said fund.
Ordered that the bill of Mr. C. E.
Woodruff be deducted from the bill
for electric lighting after the payment
of the rent for power contracted for
by the Mayor.
Ordered that license for street drum
mers be issued quarterly at the present
annual rate.
Ordered that Mr. J. A. Collier who
has been doing special work in the
sanitary department, be put back on
regular police force October 1.

The supreme court of Georgia held in
the recent case of Foulkrod, et. al, vs
Rodgers, that evidence that a husband
managed and conducted for his wife,
aud as her agent, a mercantile business
belonging exclusively to her, giving to
it his entire time and attention, and that
his services in so doing were worth a
stated sum per month, would not, with
out more, be sufficient to show that
there was any unpaid indebtedness by
her to him for such services, nor would
this be made to appear by introducing
in evidence, in addition to the above,
the books kept in the business showing
its nature and extent and containing no
entries of any payments to the husband.
In the case of William vs. Webb, et. al.,
the court held that a married woman
who was not living separate and apart
from her husband was not. under the
constitution of 1893, entitled to have a
homestead set apart to herself out of her
own property, and that, this being so,
proceedings instituted in her behalf for
setting apart such a homestead were,
though carried to final approval by the
ordinary, absolutely void, and constitu
ted no obstacle to sale, under an execu
tion against her, of the property sought
to be exempted. In still another case
(Burnney vs. Savannah Grocery Com
pany), the court held that there was no
law or public policy in the state forbid
ding a married woman from engaging
in business with her husband as a co
partner; that where a partnership be
tween them was formed and she was
held out to the world as one of its mem
bers, she became liable to one who dealt
with the firm upon the faith of her
membership therein, and that secret
stipulations in the partnership articles
limiting the wife’s liability as a member
of the partnership, were not binding
upon innocent third persons who bad no
knowledge of the same.

Raleigh, Sept. 30.—At the request of
the sheriff of Vance county, Governor
Carr ordered out company O, of the
Third regiment, to protect two negroes
confined in the jail at Henderson, N. C.
Last Monday evening the two negroes
brutally murdered a young white girl,
because she spurned their advances.
The woman’s head was beaten to pieces
with an ax. Lynching was openly
talked of, and it was reported that a
lynching party was being organized in
the country to take the two prisoners
from the jail.
Ryder Will Be Resentenced.
Atlanta, Sept. 30.—A new date for
the execution of Dr. W. L. Ryder will
be fixed aud he will be resentenced so
that his execution will take place within
60 days after he is found guilty, as the
law requires. By an oversight Judge
W. B. Butt, who sentenced Ryder,
-fixed Jan. 15 as the date of execution.
The law requires that the execution of
a criminal shall take place not less than
20 nor more than 60 days after he is
found guilty.
Cavaiinugh Will Not Accept.
Springfield, Mass., Sept. 30.—Mau
rice P. Cavanaugh, who was nominated
for state auditor by the Democratic con
vention at Boston, Saturday, says he
will not accept the nomination. It was
a surprise to him. He says he is not a
candidate for any political office.
