conrt, and in the opinion handed down
it. is held that a representative is an
officer, and that whore vacancies occur
in such offices the governor has the
power to fill by appointment until the
next general election. This is said to
be the first case of this character de
cided in any state in the country.

Birmingham, Ala.. Oct. 27. —At
Smith’s mines, near Bessemer, two ne
groes, Ben Norflet and John Mitchell,
attempted to hold up another negro
named Henry Dale. They ordered him
to hold up his hands. Instead of doing
so, Dale drew a pistol mid ki.led Norflet
and then captured Mitchell, whom he
marched at the point of his pistol to
Bessemer and there turned him over to
the authorities. Mitchell is now in the
county jail.
Tom Delk to Hang on Dec. 18.
Atlanta, Oct 27.—Tom Delk, the
young outlaw convicted of the killing of
the sheriff of Pike county, was sentenced
by Judge Beck at Zebulon to hang on
Dec. 18. The time was fixed so as to al
low Tom to testify in his father’s be
half, who is charged with the same
crime, on the first Monday in December.
Charged With Poisoning Three Persons.

Charles F. Mussey has sworn out a
warrant for the arrest of Miss Alice
Pratt, the Musseys’ former servant,
formally charging her with the murder
of his wife’s mother, Mrs. E. T. Tor
rence, and his two children, whose death
by poisoning occurred on last Saturday.

Serious Klection Riots I i Hungary.
Budapest, Oct. 27.—Serious
riots have taken place in different parts
of Hungary. At Tynaru, a detachment
of hussars, -ffiile attempting to restore
order, was stoned by the mob and one
trooper was killed. The hussars then
charged with drawn swords and sev
eral of the rioters were wounded.
Troops have been sent to various dis
, turbed districts.
| Hie French Parliament Reassembles.
Paris, Oct. 27.—The parliament of
France, the senate and chamber of dep
uties, reassembled Tuesday The ses
sions of both chambers were merely
formal and lasted an hour. The presi
dents of the .two chambers, in their
opening addresses, alluded in strong
and sympathetic terms to the recent
visit of t e czar and czarina to France.

has appointed Julius G. Ray of the Dis
trict of Columbia consul at Windsor,
Ont.; Samuel M. Simmons of Texas
consul at Piedras Negras, Mex., and
John F. Volls of Louisiana consul at
Matamoras, Mex., all these appoint
ments being promotions to fill existing
vacancies.
